First and foremost I want to thank everyone on this board, I received allot of good advice some bad advice lol but at the end is not about what people tell you. It is about you absorbing the information and use it to help you accomplish your goals. As some of you know I embarked on this crusade last year. Since then started with scores in the low 500's I have now a 639, 619, 520 ouch "dam student loans". Anyway my hats go off to all the fine members here that take the time to help people and educate the to the best of their ability. I also want to thank BB, I know he is a controversial subject here but the fact that he is a phone call away saved me allot of time and got me answers when I needed them most. I big special Thanks go to Christine from bayhouse, credit court and credit factors. She was instrumental on preparing me for today's court hearing. Had id not been for her advice and support I honestly do not think I could have prevailed. Thank you Christine! You Rock! Last month I filed 2 lawsuits in small claims court against two collection agencies for FDCPA violations. In particular their failure to validate but continued to report my accounts. My first case was won by default CA did not go to court, I do not know the amount of $$ I will be awarded, the judge wanted me to provide a paper proving losses. I did not submit that paper yet, plan on doing so in the next day or two. Second case however was a little more dramatic. While on mediation the attorney basically treated me and my case as if there was no basis for it and tried to discredit my case. Funny enough they offered a settlement of 1000.00 at this time we went back and forth on settlement and agreed on a $2000.00 settlement and complete removal of derogatory information. If I could do it all over again the only thing that I would change is that I would have filed on the big court rather than small claims. Although I came out in good shape I do not think that this is the type of case you want to trial in small claims due to the lack of understanding of the FDCPA and the FCRA. Thank you all again and hang in there, I just recently got my first credit card in 8 years. Granted it is a crappy card with a 200 dollar limit but it is a start.
Major congratulations are due to you! You're an inspiration to the rest of us. You rock! Now, who's BB??
Wow! Congratulations FXS, you definitely inspired people by telling your story. They don't always turn out as positively as yours but the hope is there. Can't wait for my turn in court! Good job!
Congrats.....I think most of us use small claims because it's cheap and we are going for deletions VS money. I think if you're after money the other courts may be better.
