Filing Lawsuit - Eq & Tu - Help!!!

    Could somebody who has done this please, please help me? I know nothing about what I am doing, but I know that I have an excellent case if I can do this right.

    On my TU and EQ credit reports, there are two charged off accounts for $650.00. Same account number. Only difference is one is Household Bank and one is Orchard Bank. I have contacted both by mail and they have both sent letters to me stating that there has never been an account established under my social security number or my name. I have disputed these with EQ and TU, but they both keep verifying. I have sent both EQ and TU copies of these letters certified mail twice. I just today called both Orchard and Household one more time to make sure that there is nothing with my name or SS#, just to make sure that it is not something that my ex-husband might have had. I even had them check for his SS#. Nothing. I really have never ever had an account with either of these banks. SO HOW THE HELL DO THEY KEEP VERIFYING SOMETHING THAT DOES NOT EXIST?!

    Now... my questions. What can I sue for and how much? How do I go about doing it by myself? I don't want to hire an attorney. Please help me. I have never been to court for anything - so I am really green about this. But I cannot get these things off my credit report and I need to know what I need to do.

    Get Household/Orchard Bank (recently purchased by Household) to send you a signed letter stating that they do not have an account for you and that you do not owe them any money. Then send this letter to TU and EX demanding removal or else.

    That's my complaint. I did that - I sent them a copy of that letter three different times. They signed for it three times. They still will not budge on removing it. The CRA's keep telling me that they have verified it. But they obviously have not. That is why I want to sue.

    Just go down to your local small claims court. They have fill in the blank forms. You'll need the address of the authorized agent for both cra's. After you fill it out, the court clerk will tell you how to go about getting the papers served. You might want to write up a settlement letter advising them that you are doing this because they aren't verifying as they should be. That you have sent proof and they will not accept it. Let them know you will dismiss the suit for deletion. (unless you want to go for money) Have the letter served with the lawsuit.

    Another question how did it get on there in the first place.?
    Where is the party(s) reporting this getting their information?
