I am going to file against experian as soon as I am out of the shower. Can I sue the person at experian who is maliciously ruining my credit report. I know we can sue a collector but how about an employee of a CRA?
Picantel, Unless you 100% understand the legal definition of someone acting maliciously, I'd leave the employee along. Chances are about 100% they're incompetent but being incompetent isn't malicious. You may be opening up something you can't prove and run the risk of some sort of defamation crossfiling.
heh they would not let me file against her anyway. I did file a lawsuit against experian about an hour ago though and I will let all of you know how it goes. I called the employee one more time before I filed and she told me she had 5 days to decide if she wanted to do my disputes. I have been trying for months and now she says federal law let's her have another 5 days? I think not. I may not be able to file against her but I can subpoena her and it is a really long drive from texas to ohio.
Pic, I am about to file against Experian. Who is the employee you were thinking of including on the lawsuit (you can use initials) I wonder if it's the same I am dealing with. I just sent my second (5th request overall) intent to sue yesterday and gave them 5 days. There are many issues but the most is they waited 63 days before responding to a dispute I sent them CRRR, and then only responded to half of my disputes. They take the stance that their computer was updated within 30 days but somehow there was a glitch so it didn't send a results letter to me ( I got beachfront property in Arizona too...) I've had nothing but trouble. Keep us informed! Good luck.
The illustrious Kim Hughes of the Special Consumer Affairs Division. She is nice enough, and seems to be somewhat helpful in a diplomatic way, but does everything to minimize the real issues. I've dealt with worse, but Experian seems to play by some made up rules and not the FCRA. If I played by their rules, disputes would take 3 months.
