"Fin Coll Agency" Inq, FTC REPORT

    thanks for the help of the Boards, cnet, mucho appreciated. If I were alone on this it would be nowhere at all.

    Folks, if you have an INQUIRY under "Fin Coll Agency" and one or both of the following hold true:

    1) it is deleted rapidly or claimed not to actually be on your credit report, even though you see that it is

    or

    2) you receive bogus identifying information from the CRA regarding the person that made the iniquiry

    I encourage you to report it to at least the FTC:

    I am not suggesting either method to be the preferred one, but I mention my understanding is that a phone call to the FTC will get you a reference number that can be included with any documentation that you provide. This is what I was told by one rep at the FTC.

    If I have come across one VERY CRUCIAL misunderstanding that can be clarified, it is that there is a SUBSTANTIAL DIFFERENCE between inaccurate CREDIT information and false IDENTIFYING information.

    The argument that certain false identifying information is close to accurate identifying information is one that is likely to be thought up prior to providing the false information. While this *might* be a good faith error in some instances, it is NOT one in the instance of Fin Coll Agency.

    I have definitely been retaliated against because I have looked into this matter so deeply. I mention that not to discourage anyone from standing up for their rights, I just say it because I feel obligated to relate my impression that I have hit what appears to be a soft spot.

    Any consumer is statutorily entitled to learn the "clear and accurate" identifying information, namely the FULL NAME, ADDRESS AND TELEPHONE NUMBER of anyone that obtained their consumer report within the last two years if the report was obtained for employment purposes or within the last year for any other purpose. 15 U.S.C. Section 1681g(a)(3). As far as I am aware, the only exception to this is if your report is procured by the United States Government for purposes described by 15 U.S.C. Section 1681g(a)(3)(C).

    I was misinformed last year right around this time that a CRA can parrot whatever info is provided to them by the subscriber. Even after I have made it WELL KNOWN to the CRA that I am aware that this is FALSE, the CRA has ultimately determined that my request for clear and accurate identifying information is akin to a "dispute" under Sect. 611 that is now a "frivolous" one.

    One is most likely to see this INQ on a TransUnion consumer report.

    bumping up, thanks, pls report this to the FTC if you have a "Fin Coll Agency" on your consumer report.

    It is most likely to be on a Trans Union consumer report based on my knowledge.

    The month/year that I have heard of them showing up are as follows:

    08/2002
    12/2002 (mine showed up at this time)
    02/2003
    10/2003
    03/2004


    I have heard one report of this INQ showing up on an Experian CR.

    Trans Union will prefer to provide the false identifying information below VERBALLY.

    Trans Union will do everything in its power to AVOID WRITTEN disclosure. I did get written disclosure though I am unaware of anyone else who has. This is not a "knock" of any kind, rather it is to say that TU is adamant about not talking about this topic.

    Financial Collection Agency is a trade name that is owned by several corporations, none of which subscribe to Trans Union.

    2675 Paces Ferry is a nonexistent address

    (303) 444-6600 is a nonworking telephone number

    The WRITTEN false identifying information that was provided to me is close to the above:

    Finance Collection Agency (nonexistent at all times)
    2675 Paces Ferry
    Atlanta, GA. 30339

    The SKIP TRACED formerly accurate information is as follows:

    Financial Collection Agencies, Inc. (this was the DBA and I believe the corporate name was the same or else it was FCA International, LTD.)

    The area code in Atlanta changed during the mid-late nineties, I believe it was 1997-1998.

    This all fits in nice and tight for a premeditated "negligence" defense, except that I have informed Trans Union in not fewer than 15 letters sent via Certified and/or Fax to all of their offices (Pennsylvania, Chicago, and Fullerton) notifying them of the skip traced information. Trans Union keeps on telling consumers the false identifying information.

    Trans Union's attorney committed to writing THREE different trade names for "Fin Coll Agency" during the course of three weeks:

    Financial Collections Agencies
    Financial Collections Agency
    Financial Collection Agency

    Two of these were provided in a single letter to the Office of the Minnesota Attorney General.

    His purpose for doing this has become clear to me, and I won't go into it here and now.

    If a consumer gets into court with a claim related to Trans Union's concealment of the identity of the person that got their CR, I am willing to travel the distance of the globe to provide testimony on that consumer's behalf. This is blatant FRAUD.
