I recently disputed an account with the 3 CRAs and First Usa sent me a letter stating that they couldn't verify that the account was mine and basically wanted me to sign something stating this account wasn't mine and mail it in. Are they trying to get my signature or what? Anyone received a letter like this?
Don't sign anything. Send them a letter stating "Per the FCRA, since you can NOT verify this account belongs to me, you MUST delete the information from my credit reports." The onus is on them, there is NO requirement in the FCRA (or FDCPA for that matter) stating the consumer must sign something saying the account is NOT yours. How did you get a response from First USA? I have disputed with them directly and via CRA's several times with NO responce at all. The accounts were "updated" by the CRA's with nonsense. One has no late dates at all, but reportsa as R9, one lists open w/ balance, one reports paid on date, but then the notes list a completely different pay date. I have sent CRRR 3 seperate notices to EVERY address reported by all CRA's. One was an invalid address (Experian), but the others seem to go through. Still, no response, no delete from the CRAs. Not sure what to try next. What address for First USA did you use? I would love to just get ANYthing from them besides the stupid green cards for once.
I NEVER contacted First USA. All I did was dispute with the CRAs. First USA contacted me via letter from there. Also, First USA is showing the account as disputed, resolution pending. I don't know what is going on. As long as it gets deleted, I don't care.
Hi Disputer - I got the SAME letter yesterday. I kept it and looked at my reports. First USA has deleted, but they want me to sign a letter - like yours. Guess what - just like you, they ADMITTED they did not have good records on Dogman. I am not responding to them. They already put in writing they could not prove the info. aarrffff - dogman ps - IF it comes back onto the reports later, I will send the CRAs the letter. Like you, I just challenged thru the CRAs.
The only question I have is if First USA says they don't have accurate records and can't find it blah blah blah, then how did the CRAs verify the listing. Interesting!!
