I've just received something called an "Affidavit of Claim and Certification of Debt" from Gerald E. Moore & Associates on behalf of Worldwide Asset Purchasing, supposedly in response to my request. The thing is, I never requested it. Also, the Affidavit is dated 2 months before the cover letter and is from a time before I even knew how to dispute such things, much less that they claimed a debt. The contents are pretty lame, claiming a bank employee swears I opened a CC account, defaulted on this date, owe this much, etc (it's notarized). It also states that the original contract is no longer accessible but this document will be treated as the original (yeah right). Since I never requested this, and it doesn't contain a mini-miranda, would this be a violation as an improper CA communication? The whole thing is dressed up to look like a legal doc with the standard legal format (scare tactic). There are all kinds of odd things here and I would appreciate your input. If this actually was a response to a validation request, it would be woefully inadequate. How should I respond? Thanks!
Did you possibly dispute this particular debt with the CRAs? Perhaps the CA pre-dated the validation to look as if they sent this info before you asked them for validation to try and scare you off. I am nowhere near expert status on these issues-hopefully one of the Gurus will post and help you.
