I'm not sure why I am driving myself crazy with this, but... I received a bill from Hospital Recievables, Inc. "Patient Billing Service for Malpractice Haven Hospital". It says: STATEMENT: Statement for the balance...please send payment to HR, Inc. Now the ONLY other thing on there is: We are attempting to collect a debt, and any information that we obtain will be used for that purpose. (Required by Fed. Reg. PL95-109) Is there a difference between a billing service and debt collection? This bill is from about 4 months ago, and I have paid 1/2. Original couple of bills came from Malpractice Haven. If they are a 3P debt collector they have so violated the FDCPA (PL95-109 - I had to search for that first time I've seen it referenced that way) its not funny.
I don't know the answer, BUT-- It would seem that since they are putting on the mini-miranda they are a debt collector. You don't think someone would do that just to cover their butt, do you? They obviously aren't the OC.
