Fraud with using a CC...Help....

    Um. Please do not call them anymore. Let them pay for their ignorance. To serve them, you can send it to that address. When they are served, the process server can just drop it at their feet after making sure it is the right person. Where are you located? I can dig up some more info for ya. Get going on the new, newspaper and AG.

    How is a server going to just drop it at their feet at P.O. Box? Secondly, the rules of civil procedure in your state my say a process server can drop it, but in some states they must touch them with it etc. The rules for serving differ from state to state.

    I'm becoming ENRAGED at this piece of crap's attitude! Press charges immediately, If they did this to you, they most likely did it to many others. Nice little racket he has going.

    That's why I asked you where you were. But if they do not accept it, they will end up losing anyway. You can have the sheriff do it, a professional process server or if you try different ways and can prove to the court that you did, the judge can say, "Hey, you tried, they were evidently trying to get out of this", and give you a default judgment. And how can you do business out of a P.O. Box? Someone lives somewhere. Trust me, I have found people (businesses, really) that have tried hard not to be found. But you really need to file those complaints. Most likely after they hear from the AG they will fold. Make sure you don't leave it there, though. File one with the BBB and whoever else they must answer to. I'm talking about the gym, the towing company, all of them. I bet if someone digs far enough, they could find something linking them. Money is a powerful tool. Hit up the tv stations and newspapers. I bet you find all kinds of people coming out of the woodwork that they have done the same thing to. I will help any way I can. Email me if you like, and I'll go over the laws in your state. It's hard to take a stand, I know. But once you do, it makes you feel stonger and can move to other parts of your life. You're not alone. This board is here to help.

    Thanks a lot..This board is great..I appreiciate everyones replies, greatly!........I will start this journey immdiately..Contacting everyone possible!!!....i hope I can save other people from dealing w/this scam.......I am located in San Diego, and this happened in Orange County 55miles from here..... to top it off, I noticed today,on my 2001 330ci vehicle, the Tow Company damaged a piece of chrome striping along the window, along the weather striping..Like they took a screwdriver to it....It doesnt appear they broke into the car to tow it..they said they didnt.....so who knows why they damaged this....I will get an estimate on this tomorrow and also the steering wheel shakes when driven at any speed.....i know it wasnt like that before!!......i dont even want to drive it now....The estimates will be used in court too.......not only did they steal my car, they damaged it also...I will now sue the Tow Company too.....Im trying to get a street address of the Security Company...I believe to be served here, it must be handed to the Person be served....to keep this credit related, I will talk to MBNA if there is anything i can do for disputing the charge...since there was theft involved!.

    First, you are NOT talking about CREDIT CARD FRAUD! Credit Card fraud is when someone else makes unauthorized charges to your credit account or steals your identity to open new credit card accounts. This is not the case, so with your credit card company you ARE responsible for that charge on your credit account. The only way to dispute the legality of this charge will be through small claims court.

    Second, you should keep all your receipts as your "paper trail" for that night, and keep your copy of your credit card statement that proves your paying for getting your car back. Pay that off right away so you don't have to pay any interest on the outstanding balance (if at all possible). If interest will accrue, then that interest must be paid to you through your settlement with small claims court.

    I understand your frustration, but this is the only solutions that I can think of.

    I didn't mean to come on so strong. Sorry. I just didn't want anything about this to negatively affect your credit in any way. So that was my first intention behind my posting.

    Obviously you've been victimized by a sinister plot and a stupid "drug pusher" of a manager who just doesn't give a damn.

    BTW, I also live in Orange County. Which Sav-On was this? I work at a Wells Fargo in Mission Viejo, CA. I just want to make sure I steer clear of these people myself.

    I understand what you mean, thanks a lot...The Location is: 1845 palm ave, Costa Mesa, Ca...This is a Fairly Large Shopping Plaza. This isnt a highly crime area, that I know of. So be careful where you decide to leave your ride, around here...for this is happen ANYWHERE, this should not be tolerated by anyone. I hope I can make a difference..

    You can go on bbb.com and check them out, you never know. They could be on there. If they aren't, CALL them and get the info(while filing a complaint). I'll do some research about San Diego's small claims court. You should take your car to the shop and gt an estimate as soon as possible. Also, get the statement of anyone that was in your car right before the incident so they can testify about the condition the vehicle was in. And take pictures of the damage they did. I could go on and on, but tomorrow is Monday and you have a lot on your plate as it is.

    ttowns, thanks a lot!!! I checked out BBB, The security Co Showed up, w/the phone numbers and address I have. Doesnt say anything negative on the site:

    Most likely it is a disinterested third party, which will make it easy to have the case served. But cross that bridge when you get to it.

    A civil suit can be served at their physical location I would think.
    I would go after all parties. Gym, Security Co. Storage CO. and.Towing co. With both civil and criminal complaints.
    The criminal complaints would be filed with the police dept.

    ttowns, w/the agent server site you gave me, the company is listed. Lists his full name and actual Address of where to be served. No Po Box. On the phone he gave me the wrong spelling of his name! Thanks for the info, it helps!!

    If it is a company that they use for service of process, then it won't be a problem. If it's the company's CEO or something, then maybe. In those cases I let the Sheriff do it. In the links above it tells you how it must be served. It all depends. And Tony, it doesn't matter if they don't have any complaints yet. Maybe no one else has bothered to file. Be the first. You have to start with one to get to two. Get all of those complaints out now. Then when you file the suits they will probably settle. I have a link for you. It helps you find the right tv station to have their cinsumer advocate help you out. Go baby, go baby, go!

    Tony just a couple of questions.
    1* Is the gym located in a shopping center or a small mall?

    2* Who hired the Security CO. The center the mall or the gym?

    You may have still another defendant to name depending on the answers to these questions!

    The Gym is in the same Mall Plaza as all the other stores..Funny thing is,
    Gym address is: 19th St Building facing toward this street
    Sav-on address is: Newport Blvd Building facing toward this st

    Where they removed the car is: 1845 palm ave....which is the direction the car was facing...This parking lot is Directly BEHIND the gym...Everyone that goes to the gym parks here..or Sav-on, since there is a sidewalk between Sav-on and another store, its so customers can walk to there vehicles, that are parked behind the store........

    The Parking is for all customers of the mall, gym-sav-on, etc....security said that and so does the sign...

    Security is saying I EITHER walked to the apartments, next to the parking lot, or went across the street to a Community Center...On the tow bill, states it was towed because (Customer Only) and that he has VIDEOTAPE and PICTURES of me leaving the property...LOL..and If he had a videotape, then he would know where I went...Wouldnt be a EITHER....

    Started getting everything started today.... and Took pictures of the whole Plaza today.....

    Also - the cops will argue with you and tell you it's not a criminal matter, it's a civil matter. BS - Be persistant.
