FUN4U2 Case status..

    I dont recall, but I think it was Sassy and I who were talking about the case which FUN has going.

    We had started a discussion about what statute her attorney had filed under. I said it was FCRA 623 (b), which is the requirement to conduct a reasonable investigation for BOTH the reporting agency and the furnisher.

    FUN disagreed and said it was not that statute. It dawned on me after the discussion, it may have been misleading to say the suit was filed under FDCPA 623 (b).

    Althought we all know the statues by their "small numbers", the actual section which would be filed is:

    15 U.S.C. § 1681s-2(b)

    So FUN was actually right if it was filed under this as opposed to 623 :)

    AND, if 15 U.S.C. § 1681s-2 isnt right either, I AM JUST TOTALLY WRONG ALL TOGETHER !!!! LOL :)

    Hi hiding yes that was indeed the section I typed the letter from my attorney as I could not get it to post.

    finally we agree on something lol

    oh well life is good, I am still learning but at least us sharing all this stuff helps each other.

    at first I was upset, but I got over myself too lol, and realized I need to be open to accept that some laws

    no matter even if the consumers are right if you dont present your case properly the judge does not find the law in your favor.

    from what I read it seem that you & butch have some court experience, I only have dealt with the CA and CRA and have had success and havent had the need to pursue things to this level yet, but since i have 2 cases that are going that way I appreciate all your input.

    Thanx for the plug FUN, but nope, no court experience here.

    It was old Ben Franklin who said;

    "Emtpy the coins of your purse into your mind, and your mind will fill your purse with coins.



    Hiding and I both have, and have studied carefully, the NCLC Manuals for Lawyers.

    Labeled a "monumental undertaking" by the American Bar Assoc..

    I am truely inspired now and want to get down to the nitty gritty as my mom used to say lol.

    Its hard for me as my time is limited but Ill keep looking I have seen some of those NCLC but not many.

    Im still looking up other stuff so ill post again when I can thanks for the FUn :)
