Garnishment in Jersey

    I read somewhere that they can only take 10% of your gross earnings but if you make over a certain amount a creditor can petition the court to take a higher amount, is this true?

    Federal law limits garnishment to 25% of disposable income. Disposable income is wages earned after normal deductions (taxes, FICA). However, if the garnishment is for taxes, then the rules change.

    Can they touch your income if it is from social security or va disability?

    What you're looking for is N.J. Title 2A Article 17 Sec. 56 This is about wage executions. Unless you're in poverty than they will probably ask for 25%. I was born and raised in N.J. but live in Ok. now.
