We have a judgement form 1997 that we have been paying off via a wage garnishment since 1999. NOW it shows up on our Transunion and Experian CR as a "pay after charge off" We though that after this year it would fall off ( judgement shows 12/97). Is this not a double jeopardy item? Is it becausee we are involuntarily paying for this that they are allowed to submit it or do we have a way to get it off?
Go to the Amason Letter for the answer. The Status date of the Judgement is the date the Judgement was enetered in Court. Yes, this is different from the original debt, where teh Status Date is 180 days after the date of the first missed payment. This is because reducinga debt to Judgement creates a new classification for the debt - it is now Public Record. So.... 7 years from December 1997 is December 2004. That's when the Judgement comes off. The original trade line should already be off. "Paid After Charge Off" on the Trade Line does NOT extend or renew the Date Certain in FCRA. I would be talking with the CRA about how that trade line got back on, because, if you were me, someone is getting sued - it's just a matter of WHOM.
