Can the money you have on a credit card be garnished in the state of ny?

A wired plastic cc is a stored value card. (garnishable)

A Capital one card can't be touched because its not a stored value card right?

    If so why?

Assuming the stored value card is in fact garnishable, I would venture to guess the reason is simply because the storved value acts like a savings account with a debit card. Your money was deposited and you are not lent any sort of credit.

A regular credit card (you used Cap One as an example) is just credit. The money is Capital One's, not yours. You pay them back each time you use it.

ok great, thanks for the help.
I don't think wired plastic (stored value) uses a bank account.

    thanks
