A $50.oo deposit. I never did get the deposit back and the 50 bucks was never credited to my account either. When I asked them for the deposit back they said they had sent me a check for it. I had them send me a copy of their check to prove it. The check was made out to me. On the back it was endorsed with my name - only problem is the endorsement was not my signature. Someone else had signed my name on the back of the check. And something else the check was not deposited into my check account at my bank. It was deposited in the gas companies checking account at their bank. Isn't this forgery
Yes and its a Felony, someone at the gas company stole your check before it ever hit the mail. And probably someone on the inside at the bank busted it (police term) for them. Pursue it with your local police dept.
I think the Gas Co. just simply made their check out to me turned it over and signed my name on the back and took it to their bank and deposited it in their own bank. I don't think there was ever any attempt to mail it to me or anywhere. They just took it straight to their bank and deposited it there.
Re: Re: ***GasCo. Check Forgery~~~ There may be several numbers on the back of a check as it is processed through the clearing system, along with dates. Somewhere, either near the signature, or possibly on the front, should be the account number to which this was initially deposited. Is this account number the account of the utility company? There should also be bank records that show the manner in which this was presented, such as by an individual at a teller window, dropped off at a night deposit, or whatever. Is there any indication that the check was cashed, and not deposited to an account. First you should notify the utility company promptly, in writing, CRRR, that the check they sent you copies of was not received or deposited by you, has a forged endorsement, and the account number into which it was deposited was not your account. If one of their employees is pulling something funny, intercepting returned deposits, or grabbing them if they are returned by accident or undeliverable, they need to know about it. Demand that they send you a replacement check, since you have not received your refunded deposit, and their check copy shows that you were not paid. Since the signature is forged, file a police report. Whether they pay you or not, no-one should be forging your signature. You can also file a complaint with the Postal Inspector, since they claim to have mailed you the check, mail theft may also be involved. If you have notified the utility company of the theft, they also have an obligation to file complaints with both police and Post Office, instead of just brushing you off. If they don't respond quickly, file a complaint with your public utilities commission, referencing your police and postal inspector complaints. They should be the ones stuck, not you, provided you don't delay in notifying them. You might ask on bankersonline.com to see what they say you should do.
Re: Re: ***GasCo. Check Forgery~~~ The only thing that keeps one company's accounting system honest and accurate, other than the honesty and accuracy of their employees, is the checking done by other parties as they transact business. To audit, you check that the records match.

They told me that my check must have been returned to them undeliverable. I asked why they would deposit it then- why not just destroy it. They replied that is was for accounting purposes. I think that they are playing the "rebate lottery". Do it and hope people forget or don't care. FYI- They gave me a new check that day on the spot.
