Congrats!!!!! I just had one bump off today leaving me with one from last week. Quick question for you LKH about reinsertion. I had a late pay listed with EQU on one of my tradelines, the late pay was deleted a few months ago, but not the tradeline, today the late pay was put back in. Any recourse for me?
Well, they need to notify you within 5 days. They also, need the info to be "certified". And, they are supposed to have procedures in place to prevent the re-reporting of previously deleted info. I would first call them and suggest that it needs to be removed asap as it was previously deleted. If that doesn't work, I would then send a letter to the cra threatening them with the violations of reinserting it, didn't notify you, didn't have procedures in place to prevent this. The relevant part of section 611 of FCRA is below. B) Requirements relating to reinsertion of previously deleted material. (i) Certification of accuracy of information. If any information is deleted from a consumer's file pursuant to subparagraph (A), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. (ii) Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency. (iii) Additional information. As part of, or in addition to, the notice under clause (ii), a consumer reporting agency shall provide to a consumer in writing not later than 5 business days after the date of the reinsertion (I) a statement that the disputed information has been reinserted; (II) the business name and address of any furnisher of information contacted and the telephone number of such furnisher, if reasonably available, or of any furnisher of information that contacted the consumer reporting agency, in connection with the reinsertion of such information; and (III) a notice that the consumer has the right to add a statement to the consumer's file disputing the accuracy or completeness of the disputed information. (C) Procedures to prevent reappearance. A consumer reporting agency shall maintain reasonable procedures designed to prevent the reappearance in a consumer's file, and in consumer reports on the consumer, of information that is deleted pursuant to this paragraph (other than information that is reinserted in accordance with subparagraph (B)(i)).
Anyone still having trouble pulling a Equifax report in the last 2 days? Error 45D?? Any suggestions?
Error 45 D is the one I got, and several others here, just before the deletions started on individual reports. Call Creditwatch and ask them to fix it. It will take 10 seconds. Once that happens, you will start seeing the inq deletions.
Re: George, KHM and Saar - bumpage Thanks, LKH! The woman I spoke with said she would escalate it to a technical person who would get back with me tomorrow. Bumpage, here I come! Doc
Re: George, KHM and Saar - bumpage The lady I spoke to said that my file it too Big and they will contact me within 5 days of receiving the error code. Which is no late than Tuesday. To advise me of something further.
Re: George, KHM and Saar - bumpage That is a little strange. When I called, they "cleared the que" and I was able to see my report as soon as I logged in.
Re: George, KHM and Saar - bumpage Hope it works!! Wow, I feel honored. There was Docs trick, DaveLV's trick, and now I have my own trick = LKH's trick. LOL
Re: George, KHM and Saar - bumpage No one contacts you Reshod. The only email I got was the one saying they might split my file.
Re: George, KHM and Saar - bumpage We went through the same thing. Sent a scathing email telling them they better not split the file. They replied with a form email back saying they might split the file. Needless to say our responding email was even more scathing. 8 days later nothing had been done, we called on a Friday night, they said they would pass it along to the technical department. We said if they didn't get it straightened out we'd sue. (That day we had our banker try pulling the report, he couldn't get ANYTHING AT ALL.) Saturday, the same customer service rep called us back and indicated the technical department was working on it and we should hear something from them by Monday. It started working again on Sunday. Now here's the strange thing. We can find no difference whatsoever in the before and after report. They removed nothing from any info we can see to get it working again. And BTW, we have had bumpage both before and since this incident. DemPooches
