I have a chargeoff reporting from Citi. Just deleted in good faith from Transunion, ans Equifax this morning. After disputing this several times with EX as "Unauthorized Charges", and "Not Mine", they moved it from my negative to positive. Is this a FCRA violation??. I can only assume that EX thinks the lay person would think this was a good thing now. It is not, still shows as a chargeoff. Anyone have any feedback on what to do? Please tell me that this will not now show for 10 years instead of seven?. EX is real slick! No negatives left except this on EX. Does anybody know a fax # for Experian? or any Supervisors #'s??
By law it should come off in 7 years (plus 180 days) after the initial default. Have you asked them when their system says it will come off?
Hehe, I thought it was good, until I saw the word chargeoff in yer post. I wish ya luck with this, cause this happened to be awhile back with a stupid chargeoff, and not knowin what I was doing, I disputed it as 'never late', or something silly like that....and I had a hard time getting rid of it! Anyhoo, me wishes ya luck with this!
It says it will come off in aug 2008, however that is incorrect. it would come off on aug 2007 like the other two were reporting. But the other two deleted it, experian just moved it from neg to pos I can only assume to shut me up. I will though keep at them that seems to work.
hmmm Without rehashing Butch's fantastic treatise on the 7yr issue, let me make it simple. Date Certain is the Date of First Default DOFD.... the 30 day late report that causes the never corrected default condition. The FURNISHER of the tradeline must REMOVE the reporting at 7 years. So at 7 years + 1 day, sue the FURNISHER. FCRA violations stack up fast. The CRA must remove the reporting at 7 years + 180 days MAXIMUM. This provision for 180 days was placed under FACTA to protect the CRA's from lazy or lax FURNISHERS so they weren't instantly on the hook for furnisher violations. So at the 7 year + 180 day + 1 day point, SUE the CRA too. As always, dispute with the CRA, and dispute with the FURNISHER, nailing down your Private Right of Action for court. Then when the matter is not corrected, SUE.
Eq and TU have deleted this account. Will that help me any if used against EX. You know like "Hey the other two deleted it", send copies of the delete to EX from the other two.
I know what ya mean, and others might disagree, but I always get antsy when I see people wanna do this, cause since each the bureaus don't care what the others do - then telling 1 that the other 2 deleted, etc....they won't usually care. And, yikee, ya don't wanna send your personal info to another bureau too, cause you gots no idea who might open that letter with yer reports in it.....and we don't want ya coming here later saying someone stole your id
Hello there. Been a while. I see you are finally making progress with Citi. GOOD FOR YOU!!! Experian is ridiculous. That totally sucks what they did to you. I will keep searching. If I find something that can help you...I'll keep posting. What was their reason for the move..or did they even give one? I bet they didn't. Losers.
Hey reatha, apperantly Experian aka Credit Data Services is the local name here in Tampa Fl, just acress the bay for me. I have filed a complaint with the BBB in which they ARE A MEMBER. The other two deleted this account, however this one thinks it's funny to place a chargeoff in the positive section. Good news though after this is off no more negatives!
