Gettin down to the nitty gritty

    OK gotta â??nother. I am having my attorney draft an ITS to a OC that refuses to answer validation letters. The derog is also still on my report. 1st letter to OC was sent in November-Second letter was sent 40 days later. No replies from OC. During this time I also asked each CRA to verify and of course they all wrote me to inform me that the account has been verified as mine. I actually have two charged off accounts from this OC on my reports. I only disputed one back in November because I had so many other things to get off my reports when I started this. I wanted to start with the oldest stuff first. My question is this, now that I am using my counsel to help me on this, and it seems to me that they have very obviously violated the law, should I use this opportunity to tell them in this ITS that they also should remove the other derog while they are at it? Surely there is some slick way to approach this.

    Actually just today I sent the letter with changes that he made. It looks like the new FACTA changes to the FCRA law allow me to dispute directly with "data furnisher" but the regs have not been written yet. It is a strongly written letter threatening a suit. It just blows my mind how strong the banking lobby is in this country.

    Thanks for the clarification Pale Rider. I think that now I just need to go back and make sure that I set them up properly with my dispute letters.

    Got a TL deleted over last night from one of the CRA's. I dunno if it was because the OC mentioned above recieved the letter yesterday or if it was because of the third dispute that I sent to the CRA's about two weeks ago. I'll update when I get confirmation in the snail mail. Looks like my letter may have worked out and fast! I am so thankful!

    Another CRA deleted the above mentioned account that leaves Transunion which I'm not too worried about as they have been fairly responsive to my communications. Still don't know if it was the nasty letter that I sent OC or the disputes that I sent to the 3 CRA's. Will update as soon as I know.

    Transunion deleted yesterday. This had to be a result of my letter to OC. Who I will now reveal as PROVIDIAN. I do not like to mention names when I am in the "process". This letter was a good one and cost me some buckage but the desired effect was acheived. These jackholes better not post any more crapola on my report in the future. I am getting weary of all this. Anyone who would like to get a copy of this one can e-mail me at zbest@consolidated.net. Now I am waiting on my court date with Equifax for reinsertion. I hope that I can help someone in my similar situation in the future with this thread. I am DONE here!

    CONGRATS!!! What an encouraging post. I can't mail directly from this site either. I am going to write to you for a copy of this letter too! Can never have too much arsenal in these situations.
