Getting down to CC 7-year date

    Folks, some thoughts on this, if you will, please:

    I had a BK13...coming off next year. Anyway, the remnants of 2 CC's are on my CRA's sporadically. Not all reflected on all 3. Anyway, I'd like to get down to the date when the 7-year clock should have started ticking.

    One is off in 11/02..so I'm not really focused on that one...but one other is different on 2 CRA's.

    So, how do I go about getting down to the "commencement of the delinquency which immediately preceded the collection activity" which preceded the BK13?

    If I requested a statement of my account from the CC, would I get it? Are there any risks? Any ideas at all?

    nANA,

    Get a statement of acct from your ch13 Trustee. It will show every penny paid to the CC's and when.

    Butch, that won't work, but thanks! I want the date of my delinquency with the CC.

    Anybody else have an idea how to get copies of my statements from some CC's in this situation? Think contacting them will cause me more grief?

    OK, is it that no one knows the answer to this? Surely someone has had to do this here....am I going to be breaking new ground? You know I'm gonna keep bumping this until I find out...teehee (as in, you know you are going to sit right there until you eat your green beans).

    Or....is everyone mad at me cuz I was grumpy yesterday? Or cuz I have a pirate history? My lame sense of humor? Because my hockey team rocks? Maybe it's so obvious I should know it already and I'm having one of my "moments?"

    Hmmmmmmmmmmmmm? LOL

    Have you checked your State's laws for THEIR rules on credit reporting?
    Have you kept ANY of the old bills from the OC that would show a "past due" or "late charge" notice.?
    As you know, prior to Jan.1998, the CRA's only had to figure 7 years from the charge-off date,but many States have enacted a rule that in effect makes the 1st date of delinquency applicable even if prior to 1998.

    Alright, no, if I had those bills, that would be what I need and the date would be clear....

    My whole question comes down to, if they were in BK, do I still have a right to get copies of those bills?

    OK- let me see if I understand you,about 7 years ago you filed ch 13.? You included this subject account in your filing? You have a copy or can go to the court and get a copy? I assume that the account was in default at the time you filed? If all of the abve is correct, then all yo have to do is send a copy of the page where THAT account is listed, (mask all the others) state that at the time your BK ws filed the account had been charged off,and that the original date of first delinquency was at least 120 prior. The maximum the CRA can date the account would be the same as your filing date.But if you add, "reporting items discharged in bankruptcy incorrectly is not only a violation of the FCRA but also a violation of Federal Bankruptcy Law" I think you will see a dissapearing act!!

    Beautiful! Thanks so much for helping me out!! You make good sense! Basically, I don't need their statements because the BK dates say it all!
