GMAC Inquiry-Non permissible purp.

    Hello,

    I was wondering who GMAC is? I have a feeling they are in with GM, correct? Well I drive a 2002 Chevy Impala financed through Bank One. I am in the process of closing on a mortgage here in Columbus OH, and I got an alert from Experian creditwatch service that something new hit my credit report today. I logged in to find a new inquiry dated 04/09/04 from GMAC-the category says automotive financing. I nor my fiancee have applied for credit through GMAC. Neither of us have ever had a loan through them before as our car loans are financed through Bank One and Sky Bank. Does anyone have a contact there in their credit department. I have yet to call them. The address listed on my credit report is listed as: PO BOX 5192 Southfield MI 48086. The phone number I found is 1-800-200-4622. What should I say, who do I speak with?
    Has anyone had this happen before? My main worry is since I am in the process of closing on a home, I don't want to have any addtl credit inquiries show up. I have been sick to my stomach all day, wondering if I am a victim of identiy theft? I never submitted an application now or before for GMAC. I have a GM card but an inquiry from this probably would be listed under Household Bank. I can't find that they have any permissible purpose to pull my report. and what recourse do I have--do they owe me money??? Should I file suit against them? Any suggestions, contacts there, etc would be greatly appreciated.

    Do you know whether it is a hard pull or a soft? Perhaps they were just dong a soft to consider offering you credit?? It's a place to start.

    If you called them up, since you do have the toll-free number, I would think you'd just say "what was your PP for the inquiry" and let them explain, or delete it. Easy?

    I believe GMAC stands for general motor acceptance corporation. and is for vechicle financing, may be for a CC but I would call the # and ask for the management or financing and ask if your report was pulled for an offer of credit or an attempt to purchasesomething.

    if it was not authorized by you and you find that it is not a firm offer of credit immediately contact all 3 CRA and place the fraud alert on your report and let them know that you may be a victim of ID theft that way if anything happens you wont be held liable and its easier to remove it off your report.

    more serious cases require police reports and info from the FTC and Attorney general's office.

    Thank You for your replies. I did forget to mention this was a hard pull and not a PRM.

    I called GMAC this am, and well of course I am not in their records and the customer service representative, Valerie gave me a fax number to send my request to the administrative staff to research it. She said she would email them as well. I also visited their website again and emailed them a complaint. I am not sure if they respond well or not. I still don't know any more than I did yesterday on this reason for an inquiry. Perhaps it was meant to be a PRM and for soem reason it was coded incorrectly. I work for Bank One and realize this does happen from time to time, not that it is acceptable. I also don't think she understood it was not acceptable, she said they would have received a request for credit. I advised her I was not seeking for new credit as I am closing on a home in June. As to which she replied, "well that is weird." I did not get into too much detail with her as I felt it would be a waste of both of our times. I just hope someone will contact me regarding this inquiry, in the meantime I will fax over the request to cover all grounds. I was also thinking of sending a certified return receipt letter to the address I have as well.

    Should I call Experian or will they just advise what is on the website that permissible purpose exists and the inquiry will remain on file until 05/2006? I aslo thought about calling my loan advisor to explain the situation and that I am trying to straighten this out. I know I did not need this extra stress in my life, but I guess that is what helps make us to become a stronger individual.

    You said that you're closing on a house soon?

    GMAC does vehicle financing, credit cards.....and HOME LOANS, (at least locally in Michigan they do) and I"m guessing they do them nationwide? Maybe it has something to do with your mortgage? (just a thought) :)

    Update,

    After a week of hearing nothing, I received a letter from Tim Reeves at GMAC, stating that Experian does not differentiate between hard and soft inquiries (lie # 1). The letter goes on to state contact Experian to investigate the inquiry. He has been out of the office until today 4/28/04, so I called him this am and talked to him and he reiterated what he said in his letter, and I said Tim do you think I would be calling you or making such a commotion about this if it was considered a soft inquiry on my report. He said then if you want to make a big deal about it, call Experian to investigate. He said I called Experian and they told me what I am telling you. (lie # 2) Calmly, I just excercised my right to hang up and not create a worse problem, with someone who probably does not udnerstand credit reporting at all. It was a lesson in futility talking to him and a wate of both of our time.
    Needless to say, I have the executive/admin offices of GMAC researching this inquiry, they are in Auburn Hills MI, and I have a representative there, Jenny and her manager Bev, who left me a message yesterday and stated that this was definitely a coding error( shuld have been a PRM) and she would have the inquiry totally removed within 72 hrs. I was just trying to cover all grounds by having multiple contacts within the same company--it also goes to show you how you will still get multiple different answers to these type of requests. Which is really frustrating!

    Anyhow, I thought well, let's call Experian and see how those scum are doing today.(this was at the advice of Tim from GMAC automotive division, who I believe was cluless in the entire process) At Experian, I got to speak with a pompous representative named, Travis, who refused to do anything for me, and then blatantly refused to let me speak with a Manager. I said let me guess he or she is in a meeting? He said if I knwew where they were I would not be talking to you. He definitely got some choice words perhaps not for his companies policies or position on the matter(well yeah maybe a little bit of that too), but rather for his total disregard to customer service and compassion in understanding and listening to my complaint/requests etc. I know he probably gets it all of the time, but he definitely did not make the experience a pleasant one and that is par for the course in his line of work. He hung up on me, but I guess I was nasty and abrasive and after I thought about it, I probably would have hung up myself too if I had total disregard to customer service! LOL. He did say he would send me a copy of the CRA shwoing I could not dispute inquiries, and I said is this The Version according to Experian? He was not amused.

    So I called back, and get a nice rep., before I verified anything for her, I said will I be able to speak with a Manager at some point in this converstaion, and of course after a few seconds of silence she replied, well yes. I had to explain my siituation and she nicely understoof my position and concerns and asked to put me on hold and I waited for about 5-10 mins on hold.

    This is when a lady came on the line named, Anna, in Special Services. She then begins her conversation verifying my personal info, and then states, what inquiries would you like to dispute today? I thought do I have the right CRA on the phone? Was this Experian on the phone? Pinching myslef to check to see if I was in a dream state, I explained my situation about GMAC, and then decided to capitalize on the moment, as I had others on there that were not mine or supposed to be soft or prms, so she started disputing the inquiries at my request. I asked if she had a direct number and she said no, but when calling in she said just ask to speak with Anna in Special Services. I was like OK, she will email the results to me, and asked if I wanted to put a fraud statement on my report, I said not at this time as there are no unauthorized accounts open at this moment, but I would be inclined to do so if more situations like this arise. That ended my daily tirade with the inquiry problem. She also removed outdated addresses and employers and phone numbers, just keeping the current info on file. except for adding my current employer which she said she could not add this and it would need to be done by a creditor.

    So hopefully, eventually this matter will be resolved, but in the meantime I got Experian to investigate/dispute the inquiries on my report, except for the ones that belong to me of course, which are valid.

    At least hopefully in a few days GMAC's name should be completely off of my Experian report, and I thought about calling Tim back and just leaving a message for him letting him know that Experian really will not dispute the inquiries(even though I got them to do so.) I just want to see what he would suggest then. He also does not know that I have other GMAC executives/adminstartive workers probably in a different office(within the same company) who are also in the process of removing this inquiry for me.

    Who says the squaky wheel does not get their way.
