GMAC update

    As some of you know, I have been battling GMAC over a 1995 paid charge off. They kept verifying, and in the process updated my account with a lot more negative info. (namely 30 separate 30 day late payments, which wasnt showing before, and isnt accurate.

    Initially, I kept getting reps on the phone who told me that the account was too old to pull info on, and they couldnt send me any account info.

    I complained via planet feedback and told them I was filing suit. I got a response from GMAC thru them, saying they couldnt do anything , because I had gotten a response from their customer service dept earlier that month. That consisted of copies of 2 old letters stating that the charge off was paid in full. I argued that, and they told me they couldnt help because they didnt have access to the regional office. I sent a final e-mail to GMAC telling them I was filing suit, since they were reporting false info they couldnt verify, and they took 5 months to send me their lame excuse for validation. Today, I got a very detailed spreadsheet via e-mail, and it is full of wrong info. I am wondering if my threat of a suit is the reason for this. I responded one last time telling them that the spreadsheet is wrong, doesnt constitute proof of the debt or the late payments, and I was finished speaking to them. I wonder what will happen now? They must have searched high and low for this previously archived info. Perhaps the threat of suit does get some action. I wish instead of sending me this they would just agree to either correct or update the account. It is full of wrong info, but they are sticking to their guns...I guess I will wait to see if they respond to my latest note..will keep you all posted!

    Keep the heat up for them. You will eventually get results. Are you talking to any of the executives or just regular customer service reps?

    Hi Dustin,
    I have spoken to customer service reps, one "credit specialists/supervisor " and one account manager, what ever that is. Also, my e-mail to day was cc'ed to 3 other people, i would love to know who they are, but there is no indication in the e-mail. Maybe I should just call GMAC and ask to speak to these individuals ? :)

    Im not sure if any of these people are "high up" perhaps I should ask their exact titles? I dont want to have to file suit, because I am thinking that perhaps this spreadsheet will be seen as some type of adequate validation, even though it has errors. I dont have much paperwork from back in those days, so I cant use that to prove my case. I am going on the fact that they took 5 months to answer me, and that every time I communicate with them, more negative stuff comes out. For instance, when they sent me the copy of the old 1995 letter, it said my account was paid in full. This spreadsheet now says I still owe over $300 in late fees! I think they are just being vindictive.

    I cannot believe you have almost the same exact problem that I do!! If you will do a search on GMAC through here, you will see the h*ll I have been enduring.

    GMAC has until the 23rd of this month to respond or I file suit. I have threatened to do so for two years only to have nothing come of it. They have never responded to any of the 8 certified letters I sent them except once. And the one time they did respond they sent me a statement of my account history which showed that I had paid over and above my original contract amount. Then at the bottom they added, in handwriting, "Insurance Policy - $600.00". Now this is the amount they charged-off and have reported charged-off since 1997.

    I am asking for proof of this alledged insurance policy, time and time again, to no avail. They ignore me because I have threatened before. This time, I am following through! They have until Wednesday, then I go to file a suit.

    file the lawsuit. they'll correct it. Or if you have proof they're wrong, they'll correct it and you'll get compensated for their errors.

    So many threaten lawsuits, file and see how they jump.
