We no longer have an account with GMAC because we have paid off the loan. Here is where the problems starts back in June 2000 we had our truck reposed by GMAC we believe that they fairly repo the Vehicle our oldest son was very ill at the time and we fell in to a tail spin with our finance. We have since put a lot of time to clear our credit. Back in 2003 we purchase a copy of our credit report and saw that GMAC was reporting the repossession in 2003 not 2000 like it had happened. The were also reported that we were late 30 days in Sept of 2003 which was impossible because we had paid off the vehicle in August of 2003. So my husband called GMAC and they said the would fix the report and get back to us. GMAC did call us back letting us know that they fix the problem with all three of the credit bureau's. So my husband and I felt that we were done with this issue...Comes to find out we were just getting started in Nov of 2004 we went to purchase a new vehicle and the dealership said we may have a hard time finding you credit because of the repo that happened a year ago...Needless to say we were very angry we called GMAC and they said we will look into but for now we will send you information that will state the true happening of the repo. We did give this information to the finance company but they said it was still going to hurt our APR because of scoring issue because of the repo still being so resent on our report and they did APR based on scoring. So needless to say we got 17% on a brand new car because of the scoring. So again figured after this issue that it was taken care..again we were wrong we checked our credit again in July 2005 and found they STILL had not updates correctly. So we called AGAIN we were told the same thing again. Since Sept we moved and had our third son and have been busy so following up had been the last thing on our minds...So we just checked our credit a week ago and found it was still incorrect, we are in the middle of buying another vehicle now and don't want 17% on a $30,000 truck! So I have aggressively been on top of GMAC to fix this problem I have called as many as 4 times in one day....After over a week of calling I finally got a hold of someone who could tell me what was going on...She stated to me "I see that for two years now you have been trying to fix this issue and nothing has been done about I only see that people are making notes on your account, when they should be forwarding this information to my department (I believe she said greenly department) and I have looked back and seen no such request. She said the only reason your account is getting this much attention is because of the number of times you have called on it not because people reported the information to the correct department. She said it took me calling several times before the information was sent to the correct department. She said I told a number of the people you spoke with to let you know that we were working on this issue and that I would get back to you and the told her we won't. She said I am not sure why this wasn't taken care of before but I am waiting on a payment history from your account. So I can clear this up and report it correctly but in order for me to do that I will need someone to train me on this because I have never done this type of corrections before."

I am in the middle of this issue right now and want to know what can I do about it? Do I have grounds to sue them because they have know they are reporting this information incorrectly on my husbands account for 3 years now. I feel like I have someone in GMAC that might help me get information that might help if I can sue GMAC...Should I ask for my call record from GMAC...What would I need from GMAC to file a lawsuit against them...Since they said they would give me what I need to give to the finance company for our new truck I should be able to get whatever I need. My husband and I have had enough..We feel like they are string us a long...They have damaged our credit that we have been trying so hard to fix and they have caused us to get insane percentage rates because of recentness of this account when in reality it was almost 6 years ago not 3 years ago
