Going to court against Arrow - long

    Ok....let me calm down.

    I called Arrow Financial and I told the first CSR the problem and she transferred me to the manager.

    I tell the manager that they have failed by law to provide me with valid proof the debt is mine. He goes on to say in their eyes, it IS valid because that's the info they got from First Premier. I said it doesn't matter what you think, it matters what the law says.

    He says, thats all they need. I said "You sent something bearing my name to an address I have never lived at"...then he asks if I've tried to find out who lives there". The address doesn't exist!!!

    I said, "It doesn't matter what I'm doing with the police regarding fraud....it matter that you are continuing to report information on my credit report that you cannot validate". He says, "We did". Then he says, "We sent you five letters since last year and we haven't heard anything from you". I said if you were sending it to 055...that's why!

    He still goes on to say, "We'll accept your offer but it will report as settled". No dice guys. Now what?

    I have them on at least 2 violations - one being reporting debt they can't validate, two being they are not reporting this debt as under dispute on my credit reports.

    What do I do now? I definately want to go to court over it....it's the principle now. Screw them...I'm not paying them anything! So pros...where do I start?

    I already have a paper trail. I was calling in regards to a letter they sent me Saturday.

    In addition, I did not...and I repeat, NOT, say anything that I have not said in my letters. I was a broken record "You are to validate...that's your responsibility". I just stated the law. He asked was I threatening him with a lawsuit and I said no, I'm not threatening...and left it at that.

    But thanks. Not to mention, even if he DID tape me, he can't use it because he didn't tell me he was.

    Ummmmm, you know what comes next ;) Have you got the right address for service? Have you sent a demand letter? Then fill out the paperwork and have them served. Do it while you're still steaming mad - it will feel real good.

    I don't think I have the right address. I mean, I've sent plenty of letters to them but they have a number of addresses. Yes, I've sent the demand letter and the estoppel letter, both CRRR (that I've received back).

    Where do I go to fill out the paperwork, etc? I'm still so upset I don't know what to do! Who do they think they are? God?

    Hey....no hard feelings at all. I didn't take it as an insult or anything. You made a very valid point and I just wanted to let you know I have a little paper trail now. Again, no hard feelings at all!

    I'm just so upset right now I could spit. P.S. If I was rude to you, I apologize!

    I was just reading where I have to bring small claims suit against the person in the place where they reside. How do I do that?

    Where's Lizardking when you need him???

    Check out the Better Business Bureau's site and look up Arrow Financial at www.Chicago.BBB.org

    This will also give you all of the contact information to file a complaint with them.

    You bring suit against them where you reside, not where they reside. They are a corp. doing business in your state, with you, and they screwed up. You have the choice where to sue them.

    What state are you in (sorry I forget) - your state's corporation commission or what ever they call it, can tell you where to have them served.

    I'm in NC. They are actually an LLC...does that matter? They are however, licensed to do business in my state.

    Here's a note...I didn't even check my AG to see if their license is still valid! (Note to self).

    I have an account with Arrow Financial Services. The address I pulled from Experian regarding this company is:

    Arrow Financial Services
    7301 N. Lincolnwood
    Lincolnwood, IL 60712

    According to Experian, the address listed on your report is the address one should use to dispute directly with the tradeline. I would imagine this would cover serving papers. Hope this helps.
