I finally went down to the court house to pull my file regarding my judgment and much to my surprise ... I find a court issued citation with a notice to appear in court in May!!! The citation was filed APR. 14 ... The last time I appeared in court for this was to have it reinstated. This was back in June of 2002. I'm assuming they are pushing for garnishment as the citation reads: "This citation was issued on the basis of a judgment against the Judgment debtor in the amount stated above - On or after the court date shown above, the Court may compel the application of any discovered income or assets toward payment on the judgment." What I can't figure out is ... why if I'm making payments on this would they push for garnishment? So, what in the world do I do now ... ? ... Do I just show up to court in May and let what ever happens ... happen? I'm a little beside myself wondering what to make of all this and how to handle it! Anybody have any advice/experience w/this at all ... ? ... I could really, really use it!!!
I would like to think that if you are paying in installments and can prove that to a judge without missed or late payments .... that the judge would side with you. You may need to give more details on the acct. and the last two stages leading to this point.
