to do it. I did a search online for the local courts to see how many suits my wonderful property management company had out there. A very high percentage, so I know they wouldn't be afraid to sue me. There were some suits for only $600, well the judgement was for them so the defendant had to pay lawyer fees in addition. It appears they have some law office on retainer. I now have to come up with a settlement letter......
Here's one I have saved from this site, advice and all from the original poster: Creditor Address City, State, Zip Re: Account Number Dear Sirs: This letter is an offer to amicably settle the above account. It is not to be construed as an acknowledgment of my liability for this debt in any form. I will pay your company the amount of $____ as full settlement of this account. If you accept this agreement, I will send you a money order or certified cashiers check for the settlement amount of $______ in exchange for a full deletion of all references regarding this account from my credit profile and full satisfaction of the debt. This agreement is binding and will be void should you not hold up to your end of the agreement. Furthermore the debt will be deleted from my credit profile at all three credit bureaus or the bureaus your company regularly reports to in the course of doing business. If you agree to the above, please acknowledge with your signature and return a copy to me. Upon receipt of this signed acknowledgment, I will promptly send you a money order or cashiers check in the amount stated above. Notice: This agreement is restricted. This is not a renewed promise to pay but rather a restricted settlement offer only. By not signing below, you agree that the debt has not been renewed nor has any concrete written agreements been exchanged. Creditorâ??s Authorized Signature: _____________________________ Date:____________ Name Title : Sincerely, Do not sign or date letter (This is necessary to avoid renewing the debt, should the creditor refuse to agree.) Be sure to not use a personal check if they agree to pay. ------------------------------------------------------------
thank you jlynn. they haven't turned us into the cra as of yet, since this is a very new collection. i assume i would still use the line about not reporting our collection to the agencies though. when i last spoke with the agency, i was offered a settlement of 80% my original debt, i plan to offer 60%. do i just send the letter with that amount listed or should i call and see if they are agreeable to those terms? thanks
finally got my hormones straightened out and am going to take care of this. do you think a judge would buy my hormone defense? sorry sir, but i am out of celexa, don't feel like going to the dr., can't think straight and i let this sucker slide, but here i am. the suckers validated with copies of a faxed rental agreement. guess i am stuck. lordy, hope they settle.
I don't know what your case is about, but I'd be willing to bet that most of the cases you saw re:the creditor were for people who failed to pay their rent on time. Some people go thru it month after month. Just an FYI.
we broke our lease and owe $1500 for doing it. i keep flipping back and forth, will they, won't they? i wish i had some info on the actual court cases so i would know.
