Ok, I have had it with Arrow Financial Services. They refuse to validate and they are ignoring most of my letters except to tell me "your time to validate has past...blah blah" which is irrelevant anyway. I posted all of this background information in another post, so I won't repeat it all here.. Anyway, I have decided that I am going to sue them. My question is, which court should I sue them in, (I live in MO) and what procedures should I use? Do I use small claims court, federal district court? Does this have to be done where I live or does it have to be where they are located? I would rather not use a lawyer to do this, but I will if I have to. I would also like to sue in my jurisdiction since their chance of showing up is much less that way. Any ideas?
Sue them in Small Claims, where you live (MO). Ask for $1000 per FCRA violation, plus actual damages (but you have to prove any).
Alright all you Arrow Financial haters! I contacted an attorney in Illinois today and discussed my case against Arrow with him. He is taking the case and we are filing suit for statutory and punitive damages against them. He seems to think this should be no problem whatsoever. I'm looking forward to kicking their butts and I will keep you all informed. Got to go fax all of my documents.....
Ask him if he wouldn't mind adding more names to the plaintiffs' list!!! I'll fax him the timeline and violations! He could make more mone-e-e-y!! BTW. . . we are known as the "ARROW AVENGERS"!! ) And, I'm not kidding about adding names to the plaintiffs' list. I know that I could scrounge up about 5 to 6 just on this board alone. We wouldn't even have to put out a classified! I just sent off my letter of "Intent to Sue" today! ;o)
