Hi, I think I am going to sue BOA. The reason is there is a charge off on my credit report for a visa card with them opened in 1994. The item was supposedly charged off and sent to a CA in 97. I never had a BOA account, and I notified them before, they said they'd update the status to 'sold to another lender' and i'd have to contact them. Problem is, I sent a validation letter to the CA, and they said they sold it to another CA, who in turn sent me back to BOA. BOA still shows a R9 on my credit report, reported last 7/02 and I've tried for 6 months to get them to remove it, it is not my account, so I have nothing to worry about, about claiming fraud. My question is, what FCRA rule have they violated? How much should I sue for. It was clear cut to sue when creditors pulled hards on me after my Bk7, but Ive never sued for this situation. My suggestion is to use PFB to get them to return your call from the top. It took about 10 days but they finally got back to me. The gentleman said he will get back to me today. -Gavenraj
