Gonna Sue NCO/Marlin..who to sue?

    Ok, I have an item on my Equifax report for $143 charged off for Allegheny Power, it is reporting as Marlin Integrated Capital. I threatened to sue these jokers months ago b/c they could not validate the debt. They faxed me a deletion letter saying it could take up to 90 days to delete by automated update (this was in April) I keep disputing the account. As of July 9th, 2003 they verified as accurate.

    I already have the deletion letter (EQ wont accept this as it was faxed to me by NCO's supervisor)

    I know i have them on a violation and I am going to sue them Wednesday..but who do I sue? NCO or Marlin Integrated Capital? They are listed as Marlin on the CR..but NCO answers the phone...

    Anybody with experience suing these jokers please email me at arobinson@twperry.com. I want to know which RA to serve Marlins or NCO's.. Thanks!

    Why not look up their BBB business record and sue the holding company, naming NCO and Marlin as parties to the suit.

    Why not just name BOTH companies as defendants and let THEM fight it out as to who is responsible?

    SEND SECOND NOTICE TO EQUIFAX WITH A "HINT" OF "ITS"...GIVE THEM 10 BUSINESS DAYS CERTIFIED R/R

    You have NOTHING to lose...

    ARE THEY (EQUIFAX) "INFERRING" THAT NCO LIED???

    Many times CRAS say that INQUIRES are a "MATTER OF FACT"...but a FAX from NCO IS NOT A MATTER OF FACT???

    Well, I spent the $10.00 to file on these morons last Friday...2 days later (yesterday) I received a call from their attorney..this was a clerical error...which they were happy to overnight me a $900.00 check and UDF for.

    Easiest $900.00 made to date.
