Good experience with a CA! (kinda)

    This is what happened, do I smell a violation?

    I owned Cingular for a phone I stopped using but failed to cancel so I was charged for it, then was sent to collections. My file was given or bought by Anderson Financhial Network, and reported me as the following

    Under AFI-Only for Equifax At least 120 days or more than four payments past due COLLECTIONS ACCOUNT.

    Under ANDERSON FIN NETWORK I
    Experian-Seriously past due date / assigned to attorney, collection agency, or credit grantor's internal collection department And Charged Off 7/03 7/04 8/04

    TransUnion-Collection account

    Cingular was no longer listed at all on my reports

    While never agreeing the debt was mine I agreed to settle it for less than the full amount. I started making payments in May and after making the last payment in July they now report as

    AFNI-Only for Equifax At least 120 days or more than four payments past due COLLECTIONS ACCOUNT.
    Open collection account

    Under ANDERSON FIN NETWORK I all reporting for TransUnion has dropped off the report and for Experian it shows Legally paid in full for less than the full balance aith the Charge Off's removed. It does show closed

    Cingular is now shoing again only under TransUnion as a closed collection account WITH NO DATA for the terms, balance,past due amount Shows it Payment after charge off / collection

    Now my questions

    1) If I were making payments since May how can they still report it as a CO for July and August, then revise it after paid to straight No Data?

    2) What kind of letter would be best to send to Cingular and AFI to get them just just stop reporting.

    Once an account has been COed, it is always a CO, the only other thing that it can become is a PAID CO.

    This is why paying a CO doesn't result in any positive change to your credit score, and may in fact give the negative tradeline more recent status, which could hurt your score more in the end.

    Did you demand validation, and were they able to provide you with the validation?

    Is "NO DATA" reporting the matter completely, accurately, and verifiably?

    No, when I agreed to pay them it was before I found this place so I didn't know about validation. I assume now it's too late to request validation of the debt.


    I would say that NO DATA is not complete or accurate if the CRA's had different data last month,

    It's never too late... :)

    How were they contacting you prior to you deciding to settle?

    (If they weren't contacting you, you may have a harder time with this strategy.)

    If you can say, that you only agreed to pay them a penny, to end their harrassment (or their detramental reporting of the matter), and since you didn't admit to the validity of the original account in the settlement, you are now demanding that they prove the validity of the account, because you were somehow confused about your rights.

    Basically, I only paid you to shut you up, and get you off of my back, but now, I want to know what this alleged account was about, immediately.

    You may want to search for the Nutcase letters to get an idea.

    Got a response from my PF letter I sent them. They are sending a letter to the CRA's for deletion :) They will be faxing me that information as well. So this CA is going off my report totally :)

    He also told me Ciongular can't report it at the same time they are and I need to file a dispute. I will ask hium to fax me trhat as well and I'll send that to the CRA's
