I have this CA that listed a total of 8 collection accounts as unpaid on my credit report. They verified each as accurate. I called the original creditor and they told me I had paid these accounts, so the legal department called this collection agency and had them delete, now there was one more account listed with this place. I had been paying on a $880.00 balance to a physical therapist. The checks are made out to the Doctors office, but then they send the payments to the CA. I DO NOT want this account listed as paid collection. If I have a copy of the check made out to the Doctor, can I use this to prove I didn't pay the CA, but the Doctor?
When you agreed to pay this account, did you get a written and signed document by the doctor saying it would be deleted? If not, get one now. If he doesn't give it to you, stop paying. no point in paying if you get a negative mark.
They just received the final payment, I explained the situation with the CA to them, and they said they will still have to send it to the CA, since it was turned over to them awhile back. I told her if I went to court though, the judge would see that the checks were made out to the Doctor not the CA, so legally I paid the creditor. I think this would hold up.
