OK.. I sent a Validation letter to a CA the collection amount was 6.70 plus 25.00. (returned check fee) It originated from a record store.. They sent back (CRRR) in lightening speed a copy of a check and a sheet asking (demanding payment). The letter states (Verification of debt) but I wanted Validation of debt.. what AM I to do? I am not giving up on this (I know its a small fee and OLD) but THIS ISN't MINE ... I am going to do a search on this board for folks for similar situation but PLEAS if you have any advice, words of wisdoms or even know a joke or two please respond to my post...
Go to the bank that the check is drawn on, have them verify that the check is not yours and have them notarize a statement for you or have them draft a letter on your behalf.

Why pay if its not yours AND have you will still have it reported to Chexsystems (or a similar report)?
Everybody - PLEASE put "pulse" on ignore. This is exactly what pulse wanted to do. Send a flurry of posts that protecting your consumer rights don't work, with the lesson that it's better to just do what the collection agency wants. The lucridity of such an attack on CreditNet culminates here - where pulses advises a person to pay a debt that is not even his. Just so you know, pulse is most likely an undercover collection agent. PLEASE, PLEASE put pulse on ignore!

So, whose check was it? A similar or the same name? Do you have a very common name? Was it drawn on a bank in your area? Is there other information on the check, like SSN or phone number? A copy of the check doesn't prove it was your check. Scan a check, make it out to yourself and put a fake "signature" on the signature space (preferably the person who signed the letter). Put "sample" in red across the face of the check. Find the page in the phone book with all the people who have your name, copy it and send it to them. Enclose these with a letter saying "this check doesn't prove anything. You must prove that this check is mine." Also, you can call in the big guns, if it really isn't yours- your state's banking commission and AG, the OCC, and the Fed Reserve. They oversee banking. Also the FTC, since this CA may need investigating.
