I donâ??t know exactly what it means or what I should do, I need advice. This is what the fax says: â??We [CA] have not reported this account to the Credit Bureaus. I am unsure what you are seeing besides the clients reporting which is done by [OC], if they do report. We have nothing to do with the credit reporting that is done by [OC].â? The charge-off was only being reported to one CRA. Could they be telling the truth? Should I go to the OC for the deletion?
This is good news -- they're scrambling to tell you: "Hey, not us, it wasn't us, don't point at us, it's the MEAN OLD OC, so don't be mad at us." Your next step is important. If indeed it is the CA (and NOT the original creditor) who is reporting to that single CRA, then go find the second letter in the Nutcase series (refer to the FAQ atop the board if you need to find it again), and modify it to replace the first three sentences of the second paragraph with this: In your correspondence dated xxx, you deny reporting this tradeline and refer me elsewhere. However despite your confirmation that you should not insert such data, your company continues to report this alleged tradeline to the Equifax [or whichever] consumer reporting agency in probable violation of my civil rights. I am assuming, of course, that it is the CA which is reporting that remaining tradeline since you sent the Nutcase letter to them. Have that puppy notarized for that official-sealed-document look, send it CRRR, and keep us posted! Doc
Thanks for responding PsycDoc! The note that I posted above is the response that I got from the 2nd Nutcase letter which I faxed out today and which they responded to today. I sent the the first nutcase out CRRR exactly 30 days ago. I got no response to it, so I faxed Nutcase #2 today, only I took out the line that read that I had received their correspondence, (because they didn't send a reply the Nutcase #1) and I added that this was a follow-up to the first letter that I sent to them from which I got no reply. Please excuse the redundancy of my post, I just want to be very clear about my actions. Should I send out Nutcase #2 again but with the modifications you suggest? I assumed that it was them reporting to the CRA, could I be wrong? Is there a way that I can find out?
I had been assuming that only CA's reproted charge-off's but I guess that's wrong. I went digging around in my records and found some paperwork from the OC. I must add that I paid the CA before I found out about credit net, and about negotiating for a deletion. Anyway...When I paid the CA I called the OC to let them know that the debt was paid (I thought this was what I was supposed to do.) At my request, thay sent me a letter confirming that the account was paid and that THEY "will update it to a paid charge off with all three national credit reporting agencies." I guess I over looked this sentence before. Does this mean that they really are the ones reporting it? And if so, how do I approach them(OC) with a request for deletion?

The credit report doesn't list the CA's name at all, just the name of the OC before all of the account information: "Status: Paid/Account charged off. $430 written off" So I guess I sent the letters to the wrong place (doh). So do I send a fax to the CA essentially telling them that their off the hook?
