Got Paid Collection Deleted w/this

    Thought maybe it could help some people out.. It worked for me within 7 days..

    To Whom It May Concern:
    Re: Account Q41**** This is all of the account number the credit bureaus provided on my reports.

    It has come to my attention through the credit bureaus that you claim I owed a debt to your agency which appears on my credit report as being paid. This is a request for validation made pursuant to the Fair Debt Collection Practices Act. This account is in no way shape or form associated with myself or any member of my immediate family.

    Under the Fair Debt Collections Practices Act (FDCPA), I have the right to request validation of the debt you say I owe/owed you. Be advised that I am not requesting a "verification" that you have my mailing address, I am requesting a "validation" that is, competent evidence that I had some contractual obligation to pay YOU. I respectfully request to be provided proof of this alleged item, specifically the contract, note or other instrument bearing my signature. Failing that, the item must be deleted from my report as soon as possible.

    The burden of validation falls upon Certified Services as set forth by the (FDCPA), not on the company Certified Services obtained the account from as I was told by a representative of Certified Services on 07/08/2003. Per Certified Services I had to go through the original creditor to get this account which is not mine removed from my credit report. This is confusing since the original creditor is not the one reporting any information to the credit bureaus. As I have been advised by my counsel, this is now YOUR account and the origins of said account is your responsibility to provide to me.

    You should also be aware that reporting such invalidated information to major credit bureaus might constitute defamation of character, as the negative marks on my credit report harm my credit and prevent me from enjoying all the benefits of good credit. I'm sure your legal staff will agree that non-compliance with this request could put your company in serious legal trouble with the FTC and other state or federal agencies.

    Please attach copies of:
    · Agreement with your client that grants you the authority to collect on this alleged debt
    · Agreement that bears the signature of the alleged debtor wherein he agreed to pay the creditor.

    If proper validation of this account is not made to me within 30 days from 07/08/2003 "which has been deemed in previous court rulings as sufficient time to provide validation" and/or the in accurate item is not deleted from all three major credit bureaus I will be forced to turn this matter over to our attorney.
    This however is not the route I want to go, however will if forced too without hesitation.

    I used a simular one to delete an Unpaid collection. It seems to work. My guess is when you stress to them you want to have specifics given, they can't come up with them or are to lazy to worry with it. Good job on the letter by the way.

    In this case, it actually wasnt her account.. and was from 2000... Dont know how good it would work on a newer paid collection

    I think that is a nice letter too, and good strategy. Paid CA's can be quite a hassle.

    I like the strategy of requesting validation on a paid account, it just seems to thoroughly **confuse** the creditor.
