Yesterday I was awarded another default judgment in state court for $1000. The creditors I have sued all pulled an account review (AR) without having a permissible purpose. Originally I thought that I was filing these lawsuits in small claims court, but it turns out that I had filled out the paperwork for District Court and wound up there instead. This is actually better because the corporation must hire an attorney if it wants to defend itself in District Court. Apparently the cost of an attorney is too high, so they choose the $1000 default judgment as the easy way out. To answer your next question...no, I have not collected on any of these yet. However, one of them has been in contact and is supposed to be sending me a check, so we'll see what happens. I haven't tried to collect yet, mainly because I'll be suing most of them again for ARs on other dates so I'll wait until the suing is done before I contact them for payment. Please do not view this as bragging. Believe me, I only win when the defendant fails to show up in court. I just wanted to share with everyone that state court (not small claims) has been very good to me in terms of filing these cases for non-permissible inquiries, which of course includes account reviews. I have another case coming up in March and another in April, and I will post the updates here on creditnet. OFFICIAL RECAP: Lawsuit #1: Sued mortgage company for pulling an AR on a closed-end mortgage. Defendant failed to appear. Awarded $1000 judgment. Lawsuit #2: Repeat of #1 for another AR on a different date. Defendant failed to appear. Awarded $1000 judgment. Lawsuit #3: Sued credit card company for pulling an AR on a closed account. Defendant failed to appear. Awarded $1000 judgment. Lawsuit #4: Sued mortgage insurance company for pulling an AR without a permissible purpose. Defendant failed to appear. Awarded $1000 judgment. Lawsuit #5: Sued Household. Lost on a technicality (sued the wrong party). Lawsuit #6: Sued credit card company for pulling an AR on a closed account. Defendant failed to appear. Awarded $1000 judgment. Lawsuit #7: Repeat of #1 for another AR on a different date. Defendant failed to appear. Awarded $1000 judgment.
Ya know, with all your success, you should consider moving to California. You'd be up $17,500, under Cali law, $2500 per inquiry. Congrats Greenvan....!
I haven't tried to collect yet. Most of these I will be suing again shortly, so don't want to stir the pot too much just yet. One of them is supposed to be sending me a check...but everyday I check the mailbox and it's not there. I'll give them a few weeks and then find out what happened to my check.
