Hello All, I sent a Val. letter to one of the CA's listed on my CR's. I heard nothing back from them so I decided to give them a call (bad I know). The person I spoke to said that it was gonna take 90 days to send validation but they would mark the account in dispute. I asked if I could get that in writing and to my surprise he said yes. So, today I get the letter from them and it says: We have purchased this account from OC. this account was opened on xxxx in the name of mine and a previous mailing address is xxxx. The above refrenced account is under investigation. And is being reported to the CRA's with the notation "consumer Disputes". We have ordered the info you requested and it will be sent to you once we get it. The balance due is $x,xxx.xx please contact this office to discuss this matter. We have included a postage paid envelope for your convience. WE ARE NOT A COLLECTION AGENCY Then it just has the Mini Miranda. So, how many violations in this letter? I know that the CA does not have to validate in 30 days but they cannot attempt to collect while it is getting validated right? So do I go straight to ITS or send the estoppel first? All help appreciated.
Wow. Okay, I'm a newbie, not an expert, but it's worth hearing from the sages on this board. From what I understand, the CA has 30 days to respond to your validation request, and 90 days to perform the actual validation. You may have invalidated the 30 day rule because of your phonecall, if it was within the first 30 days. They definately are trying to collect and say it's in dispute at the same time... so....I think estoppel is next, but let's hear from the experts!
Re: Re: Guidance needed A CA never has to validate. They have to quit collection attempts until they do I see one violation in that letter, and that was the attempted collection.
