Those miserable s.o.b.'s I had disputed the illegally placed entry on my equifax report last month. When I got an updated report it showed gulf state on their twice for the same account. The rep at equifax said she couldn't delete it and I would have to dispute it. So I did. Today, I checked my disputes online and it showed complete. So I called and gulf state didn't respond, which would have been another violation if they did. S0, equifax deleted both of the entries. I have 1 negative, 1 $65 collection that was paid to the creditor that the collector refuses to delete. And that's all that's left on Equifax. Trans Union has 0 negative accts. but has that stupid dismissed bk 13.
Experian - well we all know the story on that.

Congrats on the Gulf State deletion? They can't reinstate it, can they?

Well, let's put it this way, if it's Experian they can. By law they are supposed to "certify" it as correct. I know that Equifax and Trans Union, when they delete things, they "usually" are gone for good. But if they do reinsert it, that's just more trouble for them as they still haven't validated the debt and legally cannot continue with collection activity until they do.

Thanks for the good words everybody.

Martysgirl, how long ago did they put it on your report? Have they notified you yet? The way I did it was to send the validation letter and when they didn't respond, I sent the estoppel. At the same time I disputed it because during the time they are validating, they by law cannot conduct any collection activity and this includes reporting to the bureaus. Give it a shot.

    Thanks LKH

That's what happened to me. I sent a validation and a Cease and Desist only in writing letter..after their first letter. Then I sent an estopple 60 days later. I have never got anything else in the mail. I disputed with the CRA's. .. It come off later to be added back.

My biggest problem is them calling me at home and at work...!! They have just started back up..!!! Soooo now I am taking names, times, and dates that they call. This I plan to use when I sue them..

How many times do I let them call to have a HARD case in court??? And do I go after them in My state, Theirs, or Both?? I'm not to sure about this..lol..!!

I made the idiot mistake of paying these morons...it was only $76! So then I dispute it, comes off mine...stays on hubby's with a status of 120 days late as of 4/01 which is the date it was paid off, $0 balance. This is probably going to mess up my mortgage because they said no negs in 1 yr.

If you have dates, times and names, I would start right now with a complaint to your state banking dep't. and the BBB and the FTC and the Atty. General in their state. I assume you have certified receipts for everything you sent them? If so, go to your local small claims court and file.

As the owner of a collection company (www.mycollector.com) and a regular "watcher" of this board, I suggest that when the collector calls..you say..
"Hello John, (of Gulf State) I just need to inform you at the advice of my attorney that I am recording this call so that all demands made against me during this call will be properly documented. Now... what is your first and last name... please spell that for me....Great John, how can I help you today...

I GUARANTEE this will be the last call you ever receive : )

You know what - other than the 1st collection letter they sent me, they have never contacted me. But, that is good info for anyone who is dealing with collectors.

The thing with that company is, they are putting stuff on people's reports, and they don't have the right person!! They don't contact them or anything, they just put those telco debts on their CR's.

What's the Diff. between a dismissed BK & a discharged Bk??

A discharged bankruptcy has gone through all the proceedures and hearings and the judge has rule the case closed and completed.
Dismissed, as in my case, is when I filed the case, but never paid the filing fees and cancelled the case, thus the court dismissed it..

So why would a Bk that never existed be on your credit report???
