Harassment by CA

    Hello all...

    An interesting case here...some time ago, my mother went thru severe financial difficulties, and she entered a HUD program in order to save her house. She was on the program for three years, where she paid a reduced amount, with the arrears being tacked on to the end of the mortgage.

    After the program was up, her mortgage was sold to Ocwen Federal Bank. She has recently discovered that this is NOT a mortgage company, rather a debt collection agency. She has a friend that is dealing with this company, and is now taking them to court for illegally raising his payment.

    Now to my mom's problem. This company is harassing her to an insane degree. They are calling her at work, after being repeatedly told NOT to do so. They call her at all hours, even Sunday mornings!!

    I was hoping you all might be able to help me draft a letter demanding that the company cease all telephone contact with her, citing some laws...I would really appreciate it!!

    Mo,
    I am sorry to hear this. Your mom must be upset. Try and keep her calm.

    I would send a C&D letter from the sample section that would require all future communication be through mail at a specified address and not phone and NOT work. I like this one but I remove the (and/or mail) part to read "cease all communication with me by phone or by mail through any other address than above. Should your office find it necessary to communicate with me regarding any activity on this account, please do so in writing at the address above."

    I would contact the original creditor and find out what happened and why she is now being harrassed.

    Also review all the paperwork she received before during and after the transfer to find out what she signed or ignored or was railroaded through.

    If I were you I would contact an attorney if you feel she was bamboozled in any way.

    Good Luck, Post what the letters she recieved were in general and maybe we can help more.
