CAN ANYONE OUT THERE HELP ME! Diversified collections has me held captive. they wont stop calling my work they wont send proper validation i just started a new job and they have my direct # and are threatening me with garnishment (the agent says they have approval to garnish my wages) how do i get them to slow dowm, stop and i want to work with someone else what can i do immediately!!!
Certified Mail RRR validation and limiited C&D. Start racking up the violations if they keep calling after they receive the letter. Try to get a witness to monitor a call with you and document the call.
i know i sound like an idiot but what is (rrr) and C&D and can they garnish my wages right now how do i stop that!
I am definitely not even close to an expert, BTW... Send the validation request via US certified mail with return receipt requested (RRR, aka green post card), this proves they rec'd it. Limited C&D-not a refusal to pay, just your right to demand that all correspondance be done in writing. If I am not mistaken, they have to get a judgement to garnish (I am in TX, creditor or CAs cannot garnish so I am not well versed on this), if they file suit after a validation request, without validating, would be a violation. So if you validate them before they file, you should at least buy some time.
Have you told them your employer prohibits such calls at your business? And no, they can't garnish your wages without a court order. DO NOT GIVE THEM ANY BANKING INFORMATION. C & D - this is a Cease and Desist. Tell them to contact you only in writing at the address your provide. I read your letter to say that you have already sent a validation letter? Heck, I might skip over all this other stuff and fax them an Intent to Sue for their numerous violations of the FDCPA. Maybe that will shut them up.
Do i call them back to tell them C&D or by mail what if they are starting garnishment now i've been reading old threads and it says that a gov loan can garnish with just notification only
Don't call them. Don't talk to them when they call you. All communications should be by mail. Keep copies of what you send them, what they send you. Always use CRRR mail.
In addition to what everyone else has stated, get a recorder so that you can record the telephone conversation. The next time the representative calls, start the conversation off with "before I continue, do you mind if I record this conversation - you know, for training purposes and all!" Dont laugh, from what I have rad here and at other forums, the answer from the rep. is typically the sound of a dial-tone! Michael
Wait! This is a student loan?????? I believe thats a whole different ball game. From what I've read, they can garnish your wages for gov student loans without a judgment.
