I have sent the C&D letter over a month ago to ERS regarding student loans they are trying to collect. Tried to set up payment with them by letter also. Still keep getting these calls from them at work, this morning the message said "I just spoke with your Human Resources Dept". I prepared a letter to fax stating all of this to ERS. Telling them that I will file a complaint for harassemnt, etc. I am going to put a cc: at the bottom of it stating an attorney's name, what do you all think? I've read the Act and it still seems to say that CAs can have specific reasons to still call you, will they still keep calling me on the phone and are they allowed to speak to my HR dept??

They CANNOT contact you at work when you have notified them not to do so. I wouldn't even bother with the fax - I'd just go file immediately. This should get you this account deleted. However, DO be aware there is special legislation regarding student loans! But that is regarding the gurantee agency - NOT a collection agency. THEY still have to follow the rules. BTW, I don't think it would be harrasment that you'd file for - although you could ADD that. You'd file for violations of the law - check with others on the board here as to which one - I always mess up on whether FCRA or FDCRA...(messing up those intials!) Mommy2cats
