    Ok, I should have re-worded that. I know i dont have the right to DEMAND they be deleted. What i meant was back then, I had no idea that there were steps i could take to TRY to get negative TLs deleted. I thought if I paid them, my score would go up. (DUH) I had no clue that I could even request validation, settle for lesser amounts, or haggle in general with creditors. Technically, I owe this money. However...Sears has gotten paid for the washer, dryer, and stereo I bought. Those things cost about 1300 bucks. Over the last 12 years, I have paid sears approx. 2500 dollars, and never bought anything else. I know, I know... I signed a contract--WHEN I WAS 20 AND STUPID. It was my first credit card. I had no credit history, and I needed a washer and dryer. I didnt really understand what I was getting into at the time. Point is, I've given them enough of my money. contract or not. And i've definitely had this bad mark on my CR LONG ENOUGH.

    Hold on...I never told them to F off...I'm trying to settle for a lesser amount and requesting they delete all negatives. What is so wrong with that? (I know, reprorting accurate information, bla bla bla.) Its not like they're losing money. They made a very nice profit off me already. I am now in a position to pay them off completely, but I just don't think its fair to hand over 2,000 bucks without getting something in return. That TL is absolutely NO indication of my ability to pay off future loans, or CCs. In fact I've got 4 capital one cards and 2 providians, all with perfect payment history for 4 years now. Its just not right that I have to have those negative remarks on my report another 7 years, and I definitely don't think it's fair for them to charge such high interest and late fees to begin with. (i know, i read and signed a contract, shut up.) I would NEVER get a sears card today. They must have the highest interest rate in the country. Or maybe they give lower rates to people with higher credit scores? Either way, I'd never agree to those terms today, because i dont need to.

    What nonsense to think that the interest rates charged by some creditors will respond to a decrease in delinquency rates. Consumer credit card interest rates, with the exception of some issuers catering to only the highest FICO customers, are amazingly resistent to reduced costs, be it lower delinquency or lower cost of money. Today's Commercial interest rates and today's Prime Rate are the lowest they've been in 2 generations, but most credit card interest rates haven't budged downwards a bit.

    Too much, I have been following your posts on these boards for a while, and I can't see much in them except as an apologist for the credit industry. We've known for a long time that the Credit Industry has moles on this board. Come clean - are you one?

    I got a call from sears, and talked to a very nice lady for about 20 minutes. She said all she could do, as far as reporting to the CRA is concerned, is report it as 'paying as agreed' after 2 months of on-time payments. All those negatives will still be there tho. is that a deal i should settle for? I've read on here how no deals should be made over the phone, so I didnt really agree to anything. Should I write a letter at this point? Should it just say that i accept that offer or should it ask for negatives to be deleted in return for payment? what would you do?

    I know a lot of you think I should just take the original offer, but I don't see why I should just hand over more money if I'm not going to benefit in any way. Its the only open account that is a negative TL on my report. Everything else is in positive status or 'satisfied'. (and i'll get rid of those 'satisfieds' very soon i'm sure)

    I wish! Sorry if i explained that wrong....actually, they wont match my payments like that. They will only match 40 bucks a month for 6 months. Basically takes care of late charges, etc.

    Also, I should mention...as soon as this TL comes off DH's CR, he is going to get a home equity loan, and I'll be able to pay off sears completely. Should I just make payments until the loan goes thru and make an offer of settlement for deletion then?

    Yes, I'm a mole for the credit industry. I was also on the Grassy Knoll on November 22nd...

    I am not an apologist for anyone. The credit card industry sucks. However, that doesn't mean that people don't need to pay their debts. No one held a gun to their heads to sign the back of the card.

    I believe that people need to live up to their responsibilities. I also believe that people need to tell the truth. Do you disagree with those values?

    This actually sounds like a pretty good deal Sears is offering, if you are already behind right now. Are you behind? and didn't they say they would remove the last 2 month's delinqencies, or something like that?

    Depending on how long ago the Derog's are, it may not affect you much. If the lates were like more than 1 or 2 years ago, I'd just go with getting the current lates cleared off by taking this deal and then getting the balance paid off.

    An option to think about, is retype that offer letter Sears sent you, and add your own paragraph on there that if after the 6 months, of within some time frame you decide, that once you pay off the balance in full, Sears agrees to remove all Derogs from your Tradeline.

    Send it in to them, ask them to sign it and return a copy to you, upon which you will immediately begin your payments.

    They may read the letter, notice the change you made, and just go ahead with it, or they may not catch what you added but sign and return you a copy - either case, you have ammo to get Derog's deleted in the future.

    If they catch the extra clause you added and call you or tell you no, just sign the original and send it in. Tell them sorry, but you mis-understood when talking to one of their reps and you thought you had been okay'ed to do this.

    Like Butch said, there are many situtations which cause people to get late on payments, etc ... and not every one of them is worthy of a 7 YEAR SENTENCE!!!

    This is why people ask for Validation, do Disputes, etc ... not cause we are deadbeats or don't want to pay what we owe, we are just looking for fairness and a little justice.

    If the Credit Industry made some kind of Graduated Scale of how long in item stays on your CR, that would help a lot.

    For example, a 30+ day late, stays on for 3 months.
    60+, 6 months, 90+ late, 9 months 120+ a year ...

    Unpaid Collections - 3 years.
    Paid Collections - 6 months after being Paid Off.

    Judgements/Chargeoff - 3 of 4 years,

    ...etc ....

    Hell, if I got 3 months behind because of illness, job loss, etc ... I wouldn't mind one damn bit having this 90+ day late show on my CR for 9 months ... to me that would be fair, and I'd be a lot more willing to catch payments up and remain a customer ... it might would even help the consumer, if they suffered something that caused them to be late for 90 days - well they probably don't need new credit for about 9 months, give them a chance to recover.

    But 7 years!!! cause you got deathly ill or you got laid off cause your company went bankrupt or was engaged in Accounting Fraud?

    Thats! why there are people like us. For crowmom, she probably got screwed/is being screwed for 7 years for past crimes that probably do not warrant the 7 years of Derogs ... but now that she is more educated, it's time to get some of that back and from this point forward negotiate for the best deal and for deletions....
