Martysgirl...depending on how old the account is...it may now be serviced by GE Card Services. They took over about a year to a year and a half ago for JC Penney cards. A supervisor confirmed to me that they don't have any documentation on these old accounts. I sent a validation, a second validation, estoppel and finally made one last phone call and explained for the billionth time that it was not my account (it really wasn't) and that I'd tried to work with them to resolve this, but as no one seemed to be able to assist me, I felt I had little choice but to file a lawsuit. The lady took my number and a supervisor called me back about twenty minutes later. I went through the whole story again and requested anything he could give me that would indicate it was my account and he then told me they didn't have any documentation and he would send me a letter of apology and would delete it with the cra's. He did just that.

So anyway...I wouldn't even bother with JC Penney, but rather would deal with GE Card Services. I have their address, phone number and fax number if you need it. I think someone else on the board had success in dealing with them as well.

    Good luck!

    Here ya go:

    GE Card Services
    PO Drawer 103101
    Roswell, GA 30076
    (800) 552-5239

I thought I had their fax number, but apparently not. I think I did everything by mail, but kept being ignored so the last attempt (and numerous previous ones) were via telephone.

Also, the guy who helped me was Scott Taylor.

    I hope this helps!

I negotiated 20+ charged off credit cards for my father in law. JC penney was the easiest, by far. I gave them a sob story, they said we are so sorry, we won't bother you anymore, and that was it. All the other cards wanted something.

    Sears was the worst.

I did not have a charged off account but I did have several lates and JCP was GREAT about removing the items. Then they sent me a really nice letter telling me how much they appreciate my business and that they would be removing all negs...
