Two weeks ago i was listening to the radio and a credit repair ad came on, so i dialed the number. He asked me for my name, and SS#. Before giving him my social security # i asked him if this was gonna be a hard hit or a soft hit on my credit. He said" oh no, this is a soft pull and all we are gonna check is your transunion report to see if we can do something for you". Sounded good to me so i told him to go ahead. He said he could fix a few things, but they wanted too much money, even after he cut the service price in half i still said no, and have a good day. For the next few days i recieved alerts that my credit is being pulled, first on transunion, then equifax then experian. All with the same company pulling hard on my credit "american mortgage report" and reason for pulling was "real estate loan on behalf of United money tree" I luckily i got this guys name and extension at the credit repair company and called him. He told me " i will see what i can do", I told him he lied to me, and he better get those hits taken off. After calling him back for a couple days, he finally said he talked to management and they authorized letters to be sent out to CA, to ammend the pull. So far nothing has changed, but i am gonna give ole credit fixer a call on monday to see how his day is going hehe. Every point counts to me right now, and they have some nerve using a mortgage report to check your credit to fix it. It's crap. And should be illegal.
It is illegal under the FCRA. I cannot pull clients credit reports because I would not technically have a permissible purpose. You may also mention the CROA to him as well. Just as I've said, check these places out before asking them to do ANYTHING.
They definitely violated. It is illegal for a data furnisher to provide false information to a credit reporting agency.
thank-you very much guys, i was going by what i read in these forums, but hearing it from you, i looked up FCRA and CROA, i will drop those bombs on him tomorrow, just in case he never fulfilled his promise to send letters to each CRA.
Even if he/she did fulfill their contractual obligations, they have nonetheless broken statutory law found within the FCRA. I would ask for my due consideration given back in light of this willful violation. To be candid, places like this tarnish the already damaged reputation of "credit service" organizations and make it very difficult for people such as myself to conduct legitimate business. There are a few companies which actually put forth a good faith effort to comply with state and federal law, however, we are at a distinct disadvantage to those who offer snake oil. It is really up to people victimized by these violators to put an end to this . . .
Well, i called him 8am this morning, he seems more nervous each time i call him. But he assured me that they will be removed from my reports. Then tried to get real friendly with me, but i told him i have things under control so long as he gets all 3 hits off. When i came home today i got my first notification from transunion that american mortgage lender "hit" has been removed from my CR. Two more to go. Thanks for your assistance, you are a well spoken person who knows his business, i will send people your way for advice, when they are ready to smarten up.
