HELLO- I am new and have a question-thanks

    HI, I have an old debt that Asset says they own. The SOL ends in October 2006. The amount should be about 6800, but the asset company says the balance is 11,000. So, maybe this account is not mine. I sent a request for debt validation and they sent me a statement with my name and address and name of the original creditor along with the balance.

    My question is, if this debt is proven by Asset, to me mine, are they likely to sue before the SOL ends? I have no income, job, or home. Ihave been homeless and jobless for 5 years.

    Can a JDB judge, from a person's credit report, about how likely a judgement is going to be enforceable? Is it sometimes not worth a JDB's money and time to sue an unemplyed and homeless person?

    Thanks for your time and any information or ideas you have.

    My motto is let a sleeping dog lie. You've only got about 3 more months now, unless you really need it off your credit I would wait it out.

    That was not validation. Send another letter stating that you reject this attempt at validation and if they continue collection activity (which includes filing suit) they will be in violation of the FDCPA.

    I sent another letter asking telling them I reject their statement as legal validation. I am waiting for whatever they send next.

    I just hope they don't file in court for a judgement.

    If they do file, you go to court, tell the judge that you asked for validation but they didn't tell you what the amount was for or how they arrived at it. You should have mentioned in the second letter that you need an accounting of how they arrived at this number.

    If you get served, before you do anything else, post here and tell us your state, what court they're suing in, etc., and I'm sure someone will tell you how to proceed.
