If you find an attorney who is willing, you could ask for that sort of advice. Be careful you don't let somone talk you into BK just because that's their bread and butter. Because I've never spoken to an attorney about my credit repair, I don't know what kind of suggestions they would offer. Your immediate need is to deal with this situation. What does the rest of your credit look like?
That's just it. How long this is apparently too long. Or do I just keep hoping nobody else steps up before the statues run out? And where do I start myself? Is there a place on this site that shows you step by step?
Bosslady7, I am not an attorney, however, I just went through this and know exactly what you are feeling right about now. Take some deep breaths and try to calm down. This is what I would do. Monday I would hire an attorney to answer the complaint. He will know what to do, like demanding validation that the debt is yours. In most states I believe for a debt of this size they will have to produce your signed contract/agreement. I would not attempt to transfer my home to a trust at this late date, your attorney will explain it to you. I would use this weekend to search this site for validation letters and prepare them to go out monday for all your other creditors. I would pull all the collection letters and send each of them a request to validate. If they are past the 30 days for you to respond, this won't necessarily stop the collection efforts but you will have put them on notice that you dispute the debt and they must validate. There are many defenses open to you on the current debt and an attorney will know them all. One thing I would NEVER EVER DO IS ADMIT THE DEBT! I WOULD DENY DENY DENY AND MAKE THEM PROVE IT! Did BofA advise you the debt was being sold/transferred to mid first bank? Did you re-affirm the debt with mid first bank? Are you absolutely sure that this is your debt? When by your records was your last payment to the account you had with BofA? When did you first open the account? Tuit
