Help Butch!

    THIS IS THE THIRD TIME TRANSUNION SAID PREVIOUSLY VERIFIED. I SENT ALL OF THE LETTERS TO THE CREDITORS AND THEY ARE REPORTING AS DISPUTED BY CUSTOMER. THE ACCOUNTS ARE: FCNB, CAPITAL 1, MIDLAND CREDIT MGMT. AND FIRST USA BANK. WHAT WOULD YOU DO?

    Well Etheral I'm trying to get a little more info.

    Have you tried a Demand for Procedures with TU? They are particularly susceptible to them. They sometimes pretend to re-investigate and then just delete.

    Yes, they verified all accounts and sent a letter stating the disputes were frivolous.

    i sent all the procedure request letters to the Bureaus. They still verify. Transunion says dispute frivolous. What do I do?

    Did you mean the procedural request letter? If so I already sent that off. Everything came back verified.

    I really don't understand why we can't get the info. we need to try and help Etheral. Just these short one liners all the time.

    In as much as we'd like to help Etheral, we just can't until you tell us what's going on.

    Butch is right. We need you to write up a paragraph or two detailing your history regarding the disputed accounts. (Leave out any identifying information, of course.) Otherwise, there's no way we can help you navigate this. Otherwise you sound like somebody who's a naysayer ("this letter didn't work" and "that didn't work" and "nothing works -- what do I do?") who's not willing to tell us what's transpired.

    Sorry guys.

    -I sent validation letters to the CA'S.
    -Waited until I got green slips back then diputed with CRA'S
    -Sent estoppel letter to CA's 30 days after valididation letter
    -Got response from CRA's validating account and reporting "consumer diputes"
    -Demanded CRA'S to delete because of no proof from CA's
    -CRA'S verified again and account still
    says "consumer disputes"

    WHAT DO I DO?

    I also sent demand for procedures letter they verified again and called it frivolous. This is TRANSUNION AND EXPERIAN. I also spoke to a lady named Tia Cooke (supervisor) at experian 972-390-4105, she said they have already investigated the accounts twice and are no longer going to investigate. I told her that one of the accounts First USA has been reporting "consumer disputes" since last year September. She told me they aren't going to investigate it again so I must take it up with the CA. I told her since I sent them a letter from First USA stating that they were unable to clearly determine my responsibility for this account they must reinvestigate according to FCRA (a)(4), I also sent them a copy of the letters I sent to the CRA'S . She said they would not reinvestigate and I should contact the creditor.

    I kinda got the feeling you'd already done a lot of work with these accounts. :)


    Unfortunately Etheral, as this stuff is for the most part a process, which we follow, there does come a time when you may need to get really tough.

    You've gotten painfully close to actually having to file suit. The good news is this "usually" gets their attention.

    What we're trying to do is gradually increase the pressure on them until we get resolution. After all that you've already done ask yourself, "what could I do now that would increase their motivation to resolve, rather than take a step backwards and thereby demonstrate that Iâ??m not really serious"?

    I can see only 2 things. File suit, or try one more time with a) demand for procedures, b) sending proof that First USA can't find your account, c) copies of your correspondence, (to the individual CRA not the others) green cards, and a statement about lack of response, and d) intent to file suit, with a time frame attached.

    And that's on FUSA. Each account is a separate issue with it's own complications, different players with different attitudes and different problems. Trying to discuss 5 or 6 different accounts all in the same conversation about what to do next makes it hard to advise, or keep all the idiosyncrasies straight. So you mention 5 different accounts, each of which should be approached separately.

    Here's a letter, apparently attributable to LKH and Lizardking. Don't use this word for word because you'd want to adjust it to fit your situation, but it does give you an idea of where you now are in this, and where your brain needs to be. Litigious Mindset.
