Help - CA collecting old charge off

    Any help appreciated.

    I just recd at letter from Arrow Financial Services to collect a debt from Prundential Bank.

    The Debt is from a Prudentail Credit Card with my X-wife. The Account was opened in 1993, charged off in 1997. The Divorce was in 1996, and this dept was assinged to her. I paid off other collection items (reposessed car, etc)... that was also assigned to her form the divorce, buit of course she never paid. The Prudential account was charged off so it sat on my credit report for the 7 years.

    I already paid the penalty for crappy credit from my X. How can they go after this aging 10+ years later??

    Please advise how to dispute.
    Here are the details.
    Prudentail Credit Card - opened 1993, charge off 1997 for $937.49
    Collection Agency - Arrow financial Services.
    Account balance - $2762.49

    p.s. Arrow inquired on my credit on 10/07, 03/08, & 09/08, but I just received the notice 10/4/08.

    They can try to collect, but this is likely an out-of-statute debt.

    Send them the DV.

    Then sit back and let them hang themselves.

    If it is OOS and they sue, you have an affirmative defense and FDCPA and state UCC violations with which to counterclaim.

    If it is OOS, you can can alternatively send a full cease-and-desist.

    Looks like this has long expired the statute of limitations and they are not likely to collect the debt from you.

    Only if you have written something to the effect that you are going to renew the debt, can they do anything about it. If they call you up, tell them this has already expired according to state laws and why are they harassing you. You will get some idea what they are up to.

    Help with the shorthand.
    DV = Demand for Validation?
    OOS = out-of-statute ?

    There's no judgement?When did arrow pick it up?It's past sol in most if not all states.You could send them a foad letter.
