Hello everyone, I need some help in this matter, because this is one three accounts that will remain on my credit file after my disputes that will be hard to remove. I had a Cap One account I opened in 1995 with 300 secured deposit. I got into a car accident and had some financial difficulties. But my card was not maxed out. Anyway, the account was closed and I had moved. But before closing the account cap one let the account go the balance go over by $191 on a 300 credit limit. Once it was over the limit, they closed it and took the deposit and left a remaining balance. I did not bother with the card again because I thought they would take the deposit and just closed the account. Well, anyway. years go by and I checked my report and they have a balanced owed for over $700. I was shocked! I called Cap one and they told me I owed this balance. Well I was in rebuild mode and they said if I paid the balance owed they would give a new card, So I paid it in full and of course got a new measely 300 cap one card. I had forgotten that the old account was secured and did not realize until this week. I really think this was a predadotory practice on cap one's part and I want to know how should i go about getting it removed or having the charge off removed. In actuality , I paid $700 in late fees and over the limit fees because they waited to closed the account until it was over the limit and had been assessing the account ever since even after they charged it off. What should I do? I am thinking about calling Mr. Miller, but I wanted to express my thoughts and get some feedback from the board before I call MM. Thanks in advance, Cyprigirl
If you haven't communicated with Mr. Miller before, I recommend that you write him via Planetfeedback first, and wait for hs office to respond instead of calling him out of the blue. That may make him more willing to seriously consider your request/complaint.

If I'm not mistaken....didn't Mr. Miller leave CapOne? Didn't someone post that? For your sake, I hope it's not true. But if he's gone, I'd surely fight for this one. It does in fact seem predatory...waiting until it went over the limit to close the account (punks!). Do what you can...hope Mr. Miller is still around to help you out....but please, keep us informed.
Mr. Miller is still there (and as helpful as always)...I've talked to him twice in the last week. Once was to get a collection account that Cap One bought from Office Max off my report. The other was to get a hard inquiry that Cap One Auto Finance put on my report (didn't get the loan, even though I was "pre-approved" for up to 30k. He was very helpful in situation one, and we haven't discussed situation two yet (keep playing phone tag). Good Luck to you!
I appreciate the comments and I will find out if Mr. Miller is still there. I keep everyone posted of my results. He was very reasonable when I last talked to him, I hope he can help on this matter. If only I had found this board a year ago I would not have made the mistakes I have made in my credit repair mission and in a better position today, oh well just glad I am on the right track and will not go back to credit hell again.
