Help!--Creditor really messed up!

    Hi everyone.....

    I am sitting here in disbelief. One of my credit card accounts recently charged off (within last 2 months). I have repeatedly called and tried to negotiate payment for deletion (owed about $675) to no avail.

    Ten minutes ago, I contacted their recovery department to, again, negotiate payment for deletion and something amazing happened!

    The girl asked for my SSN and when I gave it to her she told me that the account was discharged via Chapter 7! My Chapter 7 was discharged in 1998, a year before I even applied for the card!

    Being skeptical, I called back a few minutes later and spoke to a different person. He told me the same thing! I asked what the balance was to be sure it matched my account and it did!

    If I dispute this as included in BK, should I include the phone number I used to get this info from? This is one of 2 remaining BIGGIES on my CRs and I am terrified that I am gonna alert them to their mistake. When I spoke with them the 2nd time, I asked that they fax me something stating that the account was in BK but they said I would get that from my trustee.

    I feel like I am holding a live hand-grenade. Any suggestions? Should I just dispute and hope for the best?

    I have seen on this board that one should not take no for an answer when disputing. I just called TU and told them my scenario and that it was holding up a mortgage process and that it had to be done immediately.

    They started to ask questions (I remember reading about stuff like this) so I took control of the conversation. They requested that I fax a copy of my BK but obviously that won't work for me so I told her I was away on business and didn't have access to the paperwork. I gave them the phone number of the folks I spoke with instead.

    She said they don't normally verify over the phone so I told her that if the mortgage was affected by this error, there would be problems. AFter putting me on hold, she came back and said they will attempt to verify over the phone and send me an updated report.

    I'm crossing my fingers.

    If you pay for deletion, you are not likely to get what you demand unless you get it it writing first and then you may still have to sue them in a court of law to get it deleted. Never negotiate with them unless you are in a position of power and simply won't put you in a position of power.
    You only have the power as long as you have the money in your pocket.

    That's your first avenue of approach. You should not try to do anything with it and the creditor however. Use it as a lever to get deletion of the whole thing from the Credit Bureau. Attack it as an incorrect or not mine listing. If they have it listed as included in bankruptcy before you even got the card, then they must be talking about someone else.

    Nope! They made the false report, let them foot the bill.

    Sure! Get rid of the bK listing first and then go after the rest. Bankruptcy is just about as easy to get off your credit file as anything else, you just have to go after it a different way because it isn't a debt like the credit card thing is. Don't worry about the debt. Get rid of it too.

    Make them eat it and then get it off your credit report too.

    You did say it was a charge-off, so it's no different than any other account on your credit file.
    Pay them one crying dime and you start the 7 year statute all over again.

    Don't negotiate anything. Fight them down to where they agree to wipe the slate clean rather than to fight anymore.
