HELP!! Experts?? Butch???

    I just got the results of my dispute from Equifax back. I disputed a charge off on my CR that is NOT mine. (110% positive it isn't mine) They said "Equifax verified that this item belongs to you".
    Now what!! I know this isn't mine, I have sent letters to the OC (MBNA) asking for proof of the debt since Oct and they never sent me anything!!! Would a procedures request letter work or is there another option?? I am so mad right now I screeeeaaammmm!!

    did you send it CRRR? have you tried just calling them and asking about it?

    btw, i have a lot of clients right now that are having problems w/getting things corrected w/the CRAs. Thats because everyone tries to dispute this time of year in hopes getting accurate poor credit removed. I would recommend redisputing again.

    call and speak with a team lead. explain the situation and ask for a redispute.

    Yes, I send everyting CRRR. I don't have a phone number for the OC. I haven't tried calling the CRA. What do I tell them anyway, aren't they just going to say that the OC verified it??

    If they do, send a copy of that letter along with your ITS to the OC. SOMEONE owes you $1000 so let's find out who.

    I a confused. I send the OC the ITS letter? Why do I tell them I am suing? Would a modified CYA Manipulation letter work?

    one huge problem i see in the credit repair game is that everyone follows the same itinerary. even the CRAs, OC's and CA's know the order in which a consumer is going to fight things. they/we aren't going to believe you because you are doing the exact same thing as every other consumer.

    have you called MBNA? not via writing, but just called and said "how do i fix this error?" a client of mine had huge success w/usbank by doing this. her letters went unanswered for about 6 months, and a simple call had her credit report fixed in about 3 days. this only works though if it isn't yours.

    Like I stated in the first post, I am POSITIVE this isn't mine.


    As for whether or not you believed me, I really don't care. I know this account isn't mine and I came to this board for suggestions on what to do next, not for someone's opinion on whether or not a debt is mine.



    Where do I find the right phone number? I have looked up a phone number for the OC with the address info that is listed on my CR and the people there tell me they have no record of anything with my name or social sec. #

    i dont really care one way or the other if it is yours - i am simply telling you from a lenders/oc's perspective.

    what do you mean right number? if you called the number listed on your credit report that should be the right number. call that number tomorrow and tell them you want it in writing that they have no record of you. then you send that to the CRA and they will confirm w/the oc that the letter is legit and it gets removed. problem solved.

    The isn't a phone number listed on my credit report for them!!! It states "by mail only" next to their address. The phone number I called them on was one I looked up on the internet for a company with the same initials in the same area with a similar address. I am not even sure it's the right one.

    Don't you mean:

    They (EQ) said "MBNA verified that this item belongs to you".

    ???


    Couple questions;

    How old is this?
    What state ya in, then/now?
    How much are they claiming?
    Is it posted ONLY by MBNA? Or is there another 3rd party collector involved?
    Did they post it to your CR before or after you sent your dispute?

    In the meantime yes, a procedures request is usually the next step. (probably in about 80 % of the cases).

    Hold off for now tho. Lets get a little more info., so we can design a strategy.

    If you're sure it's not yours what have you said about ID Theft?

    It doesn't say MBNA verified, it says Equifax.
    The open date is 10/00
    North Dakota my whole life.
    It says high balance $3000, amount due says zero.
    It must be only posted by MBNA, I don't have any collections.
    No, I sent the dispute when I saw it on my report.
    I haven't mentioned anything about ID theft. Just disputed as not mine. I have read several things here that when you mention fraud or ID theft it can do more harm than good.

    I forgot to mention that the DOLA on this is 03/02. Nothing has been reported since then. There aren't any collections on my report, so if they sold it the CA isn't trying to collect it from me. It doesn't say transfered or sold anywhere on it. I have never gotten any statements from this company. But when they verified it with the CRA don't they verify the address? So wouldn't my address with the OC have to match what the CRA has for my address? So should I go with the procedures request?

    PS. what do you mean that after 12/31 identity theft will be illegal??? Isn't it already??

    Take it easy HBB. Jenz' right, and she's just tryin to help.

    Our target is always the DF's, (data Furnishers). Those are the people who report the TL to the bureaus.

    Follow Jenz. I'd call corp HQ in the morning and scream that it's not yours. Be nice & professional of course but firm in your conviction.

    Tell them if they need a fraud affidavit to send one "THIS AFTERNOON"!!!

    I'm going house shopping and if this causes me trouble, well ... there's gonna be trouble.

    I'll see if I can dig up the phone number for corporate.

    I guess I also disputed this account with Experian and I haven't heard anything from them on it for over 60 days. I had forgotten that I disputed this with Experian in addition to Equifax. What route should I take with Experian or should I just stick with calling the OC and hope that takes care of both CRA?

    Go right to the OC. Fixing it there will solve the problem with the CRA's.

    I'm looking for a number.
