    First let me tell you how sorry I am for your loss.

    I live in California and have always thought that we were a common law state and community property state. I am probably wrong about the common law but I thought there was a timeframe (7years) amoung other things that would deem a couple a common law couple.

    As for the bills, they should be going after the estate, not your mother. Whether your parents were married or not, whether there is a will or not, they should be looking in that direction. They are definitely trying to scare and intimidate you at this time when you are not yourself emotionally. As suggested earlier, get an attorney and refer them to him or her. You should not have to deal with this right now.

    I have been in the situation where the insurance, Blue Cross and Medicare, had not paid the bills that they should have paid. We had to deal with insurance companies and creditors until we got an attorney. After going thru many differnt insurance service reps, we finally got things straightened out. My sitiation was in New Jersey, so some things may be a little different.

    7 YEARS...(COMMON LAW)...I WAS TOLD...AND I WAS TOLD THAT IN CALIFORNIA.

    You file as married, you have accounts as married, you introduce wife/husband as such...

    I know Georgia doesn't have common law marriages.

    I know a couple that have been living together for seven years, with no apparent sign that that's going to change. They frequently seem like a married couple but they don't say "husband/wife", they say "boyfriend/girlfriend".

    You a need a lawyer, if your mom is sick bad back any kind of disabilty,arthritis she maybe able to get ssi. BUT you need a lawyer I know they cost,but the can help. Sorry about your dad

    Sorry for you loss, I had this happened a little over a year ago, my father's debts were not paid because they were his and only his.
    My mother nor my sister who lived in the same house did not pay the debt.
