I need help filing out the defendants section of the small claim form. It has all the usual spaces name, address, etc. For the address the city is blank but the state field is pre-filled for NY. Now do I enter the Credit Store under the name field and their registered agents address under the address field instead of the Credit Store's actual address which is not in NY? Please help. This is my first time going to court and I want to make sure everything is done correctly. Also their is a line on the bottom that says doing Business As: Defendants Section Last Name or business______________________ First Name______________________________ Address________________________________ Bourough/Town____________________________ State __NY__________ Other info(doing business as)___________________ Phone # ________________________ Credit Store info: The Credit Store Inc 3401 NO LOUISE AVE SIOUX FALLS, SOUTH DAKOTA 57107 Their registered agent: C T CORPORATION 1633 BROADWAY NEW YORK, NEW YORK 10019 With the info provided can someone please tell me how to fill in this form? Also, I don't have a phone number for the registered agent, will this be a problem? Many Thanks
The way it is set up is because it might be an individual, someone doing business as, or a corporation. Since it's a corporation, just fill it out with the company's name and below it write the agent for service of process's name and address. I'm not sure because you are in a different place than me, but this could give you a guide. That's how I filed mine out. When you go to file it they should let you know it it's correct. I hope that this helped you in some way.
On the first line(Last name or business) I will enter :The Credit Store On the second line (first name): I should enter the registered agent name(?) CT Corporation On the address line enter the registered agent address. Now if I do it this way will it appear like the registered agent is a defendant in the lawsuit? I just want it to reflect The Credit Store but to be mailed to the registered agent. I think this is how it is supposed to work. C'mon help a novice out...
you can do it as you described, just make sure that you put the (via registered agent) or something like that. I had to have experian served in a similar manner.
