Creditnetters, I need your brains and vast wisdom for this.... I had an account with Wachovia several years ago. I filed for CH 13 in 1/01 including Wachovia in the filing. Well AFTER the filing, Wachovia sold my account to First USA. Now First USA AND Wachovia are both reporting the same account, with no designation that it was sold/transferred. I disputed the First USA account as "duplicate to Wachovia, never had an account with First USA, dates are wrong, etc, etc." First USA also lists an account as "Lost or Stolen Card." I have no idea what that is. When I got the updated report, it shows both First USA listings (neither of them were deleted). Now the First USA account showd as "charge off". It also shows a past due balance of $8765. It also reaged it. Remember--I NEVER HAD AN ACCOUNT WITH FIRST USA!!!!! Wachovia is still reporting correctly--included in cH13, zero balance. What do I do with this now? My FICO score dropped 52 points!! Thanks for your help, Lisa
Lisa, I had a minor (comparative to yours) dispute with FUSA last year over a billing finance charge issue. I wrote via planetfeedback and it went right to the Office of the President and was handled promptly. I cc'd my AG, Senators, Congressmen, etc. so they sat up and took notice and I believe they received a call from the office of the AG of my state as well. Give it a try. Otherwise, if you want to go for a lawsuit it sure looks like you've got multiple violations and could get some $$ out of it. Whyspers has a pretty good pro se site up now. Check that out, too.
are they both reporting the same account number? If so, then it will be easy to fix. I had a similar problem with Chase when I filed CH13. I sent my filing papers that listed all accounts included to prove that they were included in the BK. My report was immediately updated.
Wachovia and First USA merged, that is why they are listed as the same accounts. If it is being listed twice it is a duplication. I had something happen similar before my bankruptcy when I started getting bills from Wachovia/first usa, I thought what the H*** so I called and they told me. It is only credit card accounts to my knowledge
My problem is that they, both Wachovia and First USA, are reporting the same thing, but using different account numbers. I never had an account with First USA! I know they merged or purchased Wachovia, whatever. The bottom line is that my credit report looks like I had double the debt. Adding additional fuel to the fire, the account numbers are different--same balance, same dates, etc. Furthermore, First USA just can't get it right--one day their listing is "included in CH13." The next cycle it is "Charge Off-180 days late." The difference between those two ways of reporting is exactly 58 point on the old FICO meter.
Honey, you got some good advice from members from this board. I sympathize with your post. I, too, had a dirty deed done to me with my Radio Shack account. After RS was bought by Citidildo, my RS account, which had been reported correctly as included in bk, suddenly went to charge off status and 4554 dollars past due. My FICO dropped 50 points overnight. I called CitiDildo and faxed them my chapter 7 "F" statement, which lists creditors on my bk. CitiDildo got it right and corrected the RS account to show included in bk. Since you are bent over and grabbing your ankles, get some nice soothing ointment to make the penetration more tolerable by threatening to sue the bastards if they don't withdraw from violating you. And send them your F statement from your bk.

They did the same thing with mine. When we filed bankruptcy we included both account numbers to be on the safe side. I would think that you could dispute them as being duplicate accounts. I think they must have assigned different numbers when they got them.
Yes this is true, but First USA and Wachovia also got together for Credit Cards, I know because I used to have a Wachovia card, and suddenly I started getting statements from 1st USA/Wachovia. Seems Wachovia has been spread about all over the place
First USA bought the Wachovia Portfolio of Credit Card accounts... First Union did not.. The First Union Credit Card Portfolio was purchased By MBNA.. When Ever there is a Conversion.. The Account Numbers always Change .. MBNA does not service any Wachovia Accounts what so ever....
The issue boils down to this: Irregardless of who bought whom, 1. I now have 2 entities reporting the same exact dollar amount-$8,765. 2. The accounts numbers are different. 3. Now the total debt calculates as $17,530 (twice the actual). 4. Wachovia is showing as "included in BK." 5. First USA is showing as "Charge off, 180 days late." 6. Because of the different account numbers, the bureaus will not buy the fact that this is a duplicate account. My question is: What are my rights in regard to the reporting by First USA? I never had an account with them. They bought the account, as stupid as this seems to me, from Wachovia a full year after it was in CH 13. Furthermore, Wachovia never responded to the Trustee's call for debts; therefore, they got ZERO in the CH13 filing. So, First USA bought a debt that had no chance of EVER being paid in any way and with no leg to stand on as far as collections. Does this make any sense to anyone else? Lisa
Your best bet is probably to tell the lawyer this, or check with the trustee. They can probably put a stop to it. Send First USA a letter stating what you told us, and let them know they aren't going to be able to collect, and that to continue to attempt to do so is a violation. Dispute the account as duplicate with the CRA (have you even tried? you said you can't but it sounds to me like you haven't attempted to do so yet).
Sweet, I have definitely disputed this mess--in fact, probably 5 times each for both Wachovia and First USA. That route has been well exhausted. I like the idea you brought up of a letter relating this reporting as an attempt to collect a BK debt. That will probably work if I can get it to the right place that can take some action. Hi Lisa I didn't know if you had disputed or not. Maybe you could use some of the letters here and modify them. I would threaten lawsuit in no uncertain terms, and demand that the CRA remove the account, Get real huffy and hopefully they will back down. The fact is that you do have lawsuit fodder, and I would use it. Best of Luck and let us know how it goes.
